AN ORDINANCE IN THE MA'T'TER OF
THE ADOPTION OF THE FINAL BUDGET OF
WHATCOM COUNTY FOR THE YEAR 1984
AND RESTRICTING THE EXPENDITURE OF
CERTAIN FUNDS THEREIN
WHEREAS, pursuant to and in conformity with the provisions of
Home Rule Charter, Section 6.10 relating to the County Budget
system, the Whatcom County Executive did complete and place on
file a Preliminary Budget for Whatcom County for the fiscal
year of 1984, and
(WHEREAS, following the completion of the Preliminary Budget, a
Notice was published once each week for two consecutive weeks
in the official newspaper of said County, which Notice stated
that the County Council would meet on November 29, 1983, at
7:30 PM for the purpose of considering the Preliminary Budget
presented by the County Executive, and ultimately fixing thl
final budget and making tax Levies, and that any taxpayer might
appear and be heard for or against any part of said budget, and
WHEREAS, 17 meetings of the Finance Committee were held
between the dates of October 25 and November 26, 1983
to analyze the amounts set forth for each department in the
Budget and to make recommendations for changes, and
WHEREAS, the County Council and its Finance Committee has
analyzed the amounts set forth in the Budget in reference to
deciding whether the amounts were proper and necessary amounts
to be used by the various departments of Whatcom County for the
year 1984, and
WHEREAS, a public hearing was held before the County Council on
the County Executive's Proposed Budget on November 10, 1983,
and
WHEREAS, Notice was published once each week for two
consecutive weeks in the official newspaper of the County,
which Notice stated that the County Council would meet on
November 23, 1983, at 7:30 PM for the purpose of further Public
Hearing on the Preliminary Budget as presented by the County
Executive and the recommended changes from the Council Finance
Committee, together with the Committee's proposed restrictions
on the expenditure of certain appropriations, and said public
hearing was in fact held; I

NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council: I
Section I. Adoption of Budget
The amounts hereinafter set forth in the attached Exhibit "A"
and incorporated herein by reference are hereby adopted as the
Whatcom County Budget for the year 1984.
Section II. Provisions Restricting Expenditures.
Pursuant to Section 6.60 of the Whatcom County Home Rule
Charter, the following provisions restricting the expenditure
of certain appropriations are enacted for the 1984 fiscal
year. These provisions are an integral part of the official
budget of Whatcom County and shall be published therewith.
(A) 1. All monies appropriated from the non - departmental
(0100) portion of the Current Expense Fund for the human
services programs listed in subsection (A) 3 below shall be
expended pursuant to the terms and policies of county human
services plans. The human services plans shall identify
service needs, target populations, and methods of ensuring
coordination between public and private organizations, in order
to avoid duplication of effort, wasted resources, service gaps,
and disjointed, inconsistent or unorganized assistance to human
services clients and families. Such plans shall be approved by
the County Executive, with the advice and guidance of the
appropriate citizen board of Whatcom County government, and
such plans may be a part of other program plans utilized by
County government.
2. The monies appropriated herein shall provide for the
maximum amount of direct service delivery and shall not work to
increase the proportions of the recipient organizations'
budgets that are devoted to administrative and overhead
expenses.
3. The provisions of subsections (A) 1 and 2 above shall
apply to non - departmental expenditures in the categories of
mental health (564), alcoholism (567) , and developmental
disabilities (568).
(B) None of the monies appropriated herein shall be used for
travel, lodging, or registration expenses for seminars,
workshops, conventions, association meetings, or out of County
trips, except as is required by law for mandated training or
professional accredidation, or as may be required and approved
in advance by the County Executive (for administrative
employees) or the Chairperson of the County Council or the
Finance Committee (for legislative employees).
(C) The expenditure for Horticultural Inspector (0015- 571- 25 -00-
00) is authorized only so long as at least one full -time
equivalent inspector is assigned to Whatcom County by the
Washington State Department of Agriculture.

(D) 1. All expenditures of County agencies of $5,000 or more
for professional consulting services shall be made upon a call
for bids or proposals, with selections being made upon
consideration of qualifications and costs, except in the case
of emergencies declared by the County Executive or the
acquisitionof such services from other public entities.
"Professional consulting services" includes, but is not limited
to, services from lawyers, architects, engineers, labor
relations consultants, accountants, physicians, nurses,
financial analysts, management consultants, and computer
specialists.
2. Expenditures for architectural, professional, and
engineering services shall be made in compliance with Chapter
39.80 P.C.W.
(E) This is a line item budget. The appropriations made herein
may be expended only in accordance with the budget and
accounting line -item delineations set forth in the budget
ordinance and addenda thereto, except as may be otherwise
authorized by ordinance or by the County Executive pursuant to
his /her authority to make line -item transfers, as set forth in
Chapter 3.04 of the Whatcom County Code.
(F) To the extent they are available, motor pool cars shall be
utilized for County travel purposes by employees stationed in
the central County complex before privately -owned vehicles are
used on a reimbursement basis. The County Executive shall be
authorized to grant exemption from this provision when the cost
of a motor pool. vehicle would exceed the cost of the use of a
private automobile.
(G) All construction work authorized herein for which the
estimated cost is over $25,000 shall be bid out to private
contractors, pursuant to the bid procedures contained in
Whatcom County Code Chapter 3.08 and applicable state laws,
except as the Council may specifically authorize by exception.
(H) Any budgeted personnel positions, other than those of a
part -time, temporary or seasonal nature, which become vacant
for any reason shall only be re- filled upon written
authorization of the County Executive and determination by
him /her that the positions are essential to the operation of
County Government and report thereof is made to and received by
the County Council 14 days prior to the refilling of the
vacancies, provided that positions determined to be immediately
necessary to the operation of essential services may be filled
prior to the report being filed with the Council.
(I) Computer, photocopying, word processing and typewriting
equipment, and other office equipment and furniture shall be
purchased through the Purchasing Department pursuant to a
policy and specifications designed to promote cost reductions,
compatibility, standardization and interchangeability of
equipment, parts, and software, and optimum use of surplus
equipment and furniture. The policy and specifications shall
be approved by the County Executive.

(J) Expenditures from the non - departmental Contingent
Emergency (Disaster Fund) category (0100 - 513- 10- 42 -99) shall bb
made only upon advance approval of the Council.
(K) 1. Money appropriated for acquisition of the Mount Baker
Theatre by the City of Bellingham shall be expended pursuant to
an intergovernmental agreement between the City and Whatcom
County, providing, in exchange for the County's contribution:
- -that the facility will be open to all residents of Whatcom
County;
-- that, should the City offer the facility for rental,
agencies of County government will be able to use the
facility on a preferred, cost-only basis;
- -that the structure will be preserved as an historic
landmark;
- -that the County will have representation on any governing
or advisory body established to operate the facility.

The agreement shall be submitted by the Executive to the
Council for approval.
2. The following appropriations are to be used for
acquiring the Mount Baker Theatre:
- -Park Acqusition and Improvement 0303- 0430 - 533 -50 -64 -0400
(Mist. Equipment) Amount designated for Mount Baker Theatrg-
$50,000.00
-- Whatcom County Convention Center Fund 0141 -0034- _ Amount
designated for Mount Baker Theatre - $70,000.00
-- Federal Shared Revenue 0199 -0034- _ Amount designated for
Mount Baker Theatre - $30,000.00
(L) It is the policy of Whatcom County that at least ninety -
five percent (95 %) of the costs of the Bureau of Building and
Code Administration (0000 -0471) shall be borne by the revenue
received by that activity. The Bureau shall, in July of 1984,
provide the County Executive and County Council with an
accounting of revenue and expenditures, together with
projections for the remainder of the fiscal year, as these
relate to conformance with the policy of this subsection.
(M) No money may be expended for the Lexis computer- assisted
legal research program without the specific approval of the
County Council in advance.
(N) The Purchasing Department shall he responsible for all
office equipment maintenance and repair contracts, and with the
County Executive's approval, is the sole department authorized
to negotiate and enter into such contracts on behalf of Whatcom
County. The Purchasing Department shall take advantage of
contract consolidation and competitive bidding to promote cost
savings.

(0) The Park and Recreation Department shall develop and
present to the County Executive a five year capital improvement
plan, detailing major equipment needs, repairs, and projects,
the annual costs thereof, and the possible sources of funding.
The plan shall. be submitted to the County Council for approval
by July 1, 1984.
(P) 1. The non - departmental appropriation for Humane Society
(0100 - 539 -30) shall be expended on a contract for services
between Whatcom County and the Bellingham- Whatcom County
Humane Society covering the period January 1, 1984 through
June 30, 1934. The contract may be extended upon approval.

2. The administration is requested to examine alternative
methods of .providing animal, control services and to report
to the County Council its recommendations by February 1,
1984.
(Q) The Emergency Contingency category of the Federal Shared
Revenue Fund (0199 -0034- 513- 10- 42 -99) is established as an
unallocated reserve for human services needs. The County
Executive may recommend expenditures from this category, after
completing an assessment of needs, provided, however, that up
to $20,000 shall be utilized for the prevention of substance
abuse by youth. All expenditures must be approved by the
County Council.
(R) The Chairperson of the County Council. shall, after seeking
the advice of the Presiding Superior Court Judge, County
Executive, and Prosecuting Attorney:
1. issue a request for proposals (RFP) for the position
of Legal Advisor to the County Council, PROVIDED, that the
text of the RFP shall be first approved in writing or in
meeting by a majority of the members of the Council;
2. have the responses to the RFP reviewed by a panel of
advisors consisting of the President or a representative
of the Whatcom County Bar Association, the Presiding
Superior Court Judge, and the Prosecuting Attorney, which
panel shall recommend one or more qualified candidates to
the Council for sel.eGtiop; and
3. present to the Council by January 13, 1984 the panel's
recommendations, together with a proposed contract, for
consideration and action.
(S) The County Executive is requested to instruct the Public
Works Department to present its future budgets in a format that
substantially conforms with the current expense budget format.
(T) Preference shall be given in the granting of contracts for
P�4stodial services to qualified firms that predominantly employ
handicapped workers.

(U) The wage and salary grid shall be amended to provide that
step increases after Step 3 shall occur every other year in
ranges 21 and above. The Personnel Department shall present to
the Council such proposed documents as may be required to
implement this change.

action: "HANSEY MOVED THAT THE FINANCE COMMITTEE BE
EMPOWERED TO MAKE ANY NECESSARY MATHEMATICAL CORRECTIONS
OR MINOR ADJUSTMENTS THAT ARE NECESSARY TO PERFECT THE
BUDGET AND TO REFLECT THE ACTIONS MADE THIS DATE BY THE
COUNCIL. Motion carried."
Pursuant to the above motion, the Finance Committee
hereby approves and certifies the attached document as the
final budget of Whatcom County for the year 1984.
