HomeMy WebLinkAboutord1983-0901 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 DATE: October 20, 1983 INTRODUCED BY: Roehl PROPOSED BY: Sheriff ORDINANCE NO. 83 -90 AN EMERGENCY ORDINANCE ESTABLISHING A NO SHOOTING ZONE IN THE AREA OF WISER LAKE WHEREAS, it is deemed to be in the public safety to re- strict shooting in densely populated areas;and, WHEREAS, the County Council has previously passed an emergency ordinance (No. 83 -78) establishing a no- shooting zone in the area of Wiser Lake; and, WHEREAS, Ordinance No. 83 -78 will expire before it is possible to pass a permanent ordinance in regard to this matter and it is necessary to enact a second emergency ordinance until such time as the permanent ordinance is in place;. NOW,, THEREFORE, BE IT ORDAINED BY THE WHATCOM COUNTY COUNCIL that a new section be added to Chapter 9.32 of the Whatcom County Code to be designated subsection 9.32.160: CHAPTER 9.32 UNLAWFUL DISCHARGE OF FIREARMS AREA 9.32.160 In Township 39 on and around Wiser Lake A. It is unlawful to discharge firearms within the following - described area: LEGAL DESCRIPTION FOR FIREARM ORDINANCE AT WISER LAKE Beginning at the intersection of the North line of West Bartlett Road #498 and East line Old Guide - Road - thence North along East line Old Guide Road to the South line of West Wiser Lake Road - thence Easterly along said line to the Guide Meridian Road - thence continuing Easterly along the South line of East Wiser Lake Road to its intersection with the N/S centerline of the SE 1/4 of Section 31 -40 -3E of W.M. - thence Southerly along said C /line and the N /SC /line of the NE 1/4 of Section 6 -39 -3E of W.M. to its intersection with the North line of the Bartlett Roads to the East line of the Old Guide Road, the point of beginning. This section shall not apply to nor prohibit the discharge of firearms in the slaughter of cattle, sheep or swine, or the humane dispatch of a diseased or injured animal. C. Violation of this section shall constitute a misde- meanor and every person convicted of a violation of this section shall be punished by a fine of not more than two hundred and fifty dollars. BE IT FURTHER ORDAINED, Council finds that this Ordinance is necessary for the immediate preservation of the public peace, health, safety or support of the County government. This Ordinance shall take effect immediately upon passage. PASSED this 20th day of October , 1983.
