AN ORDINANCE CREATING AND ESTABLISHING WITHIN THE DEPARTMENT
OF PUBLIC WORKS AN EQUIPMENT RENTAL DIVISION FOR WHATCOM
COUNTY AND PROVIDING FOR ITS OPERATION; ESTABLISHING AN EQUIP-
MENT ??ENTAL FUND TO BE USED AS A REVOLVING FU14D FOR THE PUR-

rENT OF PUBLIC WORKS AND FOR THE PURCHASE OF EQUIPMENT, MATERIALS,
SUPPLIES AND SERVICES REQUIRED IN THE ADMINISTRATION AND OPERA-
TION OF THE FUND AND THE MANUFACTURING OF MATERIALS AND SUPPLIES
NEEDED BY THE DEPARTMENT OR OTHER COUNTY DEPARTMENTS OR OFFICES
AS AUTHORIZED HEREIN OR BY RESOLUTION OF THE COUNTY COUNCIL IN
ACCORD &IXE WITH CHAPTER 36.33A RCW AND WHATCOM COUNTY HOME RULE
CHARTER SECTION 2.20 AND REPEALING RESOLUTION DATED 11TH DAY OF
"ARCH 1974, A RESOLUTION CREATING A'MOTOR POOL AND ESTABLISHING
A RENTAL FUND, AND AMENDING WRATCOM COUNTY CODE CHAPTER 2.66 BY
DELETING SECTION 2.66.140/2.66.150.
!�giEREAS, the Equipment Rental and Revolving Fund created under the
authority of Chapter 36.82 RCW has been phased out by legislative action in
Chapter 67, Laws of 1977 Regular Session; and
WHEREAS, the County Equipment Rental and Revolving Fund, created under
authority of RCW 36.32.274 has also been phased out by said legislative action;
and
WHEREAS, said legislative action permits the County Council to autho-
rite the use of said fund by any other office or department of the County; and
I-THEREAS, the County Council has determined that the County Motor Pool
established under RCW 36.32.272 shall be phased out and said capital assets
transferred to the Equipment Rental Division, Department of Public Works; and
WHEREAS, Council has determined that the Vehicle Rental Revolving Fund
shall be phased out and said funds transferred to the County Equipment Rental
and Revolving Fund established under and in accordance with Chapter 36.33A RCIJ
as set forth herein; and
WHEREAS, Bulletin 181, Office of the State Auditor, Division of
Municipal Corporations, dated September 1, 1977, sets forth the procedure for
implementing of said legislative action;
NOW, THEREFORE, BE IT ORDAINED that the Whatcom County Council,
acting under the authority of Chapter 36.33A RCW and Whatcom County Home Rule

Charter Section 2.20 and Auditor's Bulletin 181 of September 1, 1977, does
hereby enact the following:
SECTION I. ESTABLISH /PURPOSE.
A. There is hereby created and established an Equipment Rental
Division within the Department of Public Works for Whatcom County and re-
established an Equipment Rental and Revolving Fund, in accordance with
Chapter 36.33A RCW, Whatcom County Home Rule Charter Section 2.20, and provi-
sions provided herein, hereafter referred to as the "Fund," in the County
Treasury to be used as a revolving fund for the following purposes: the pur-
chase, maintenance and repair of Public Works Department equipment; the purchase
of equipment, materials, supplies and services required in the administration
and operation of the Fund; for the purchase or manufacture of materials and
supplies for the department and other offices or departments of the County
government and other governmental agencies as authorized herein, or by resolu-
tion of the County Council.
B. The resolution dated 11th day of March 1974, entitled A Resolu-
tion Creating the Motor Pool and Establishing a Rental Fund and amending
Whatcom County Code Chapter 2.66 by deleting Section 2.66.140/2.11.150 is
hereby repealed.
C. The Equipment Rental Division shall have the responsibility of
the following distinct functions:
1. Equipment Rental. Maintain all equipment for all County
operations and services authorized herein or by resolution of the County Council''
2. Central Stores. Purchase and hold in inventory all mater-
ials required for road maintenance activities, and purchase and inventory
materials required for the maintenance of vehicles and equipment fleet.
3. Pits and Quarries. Operations for the purpose of manu-
facturing and supplying of rock, gravel, asphalt materials used on County roads
for maintenance and minor construction activities.
4. To maintain fiscal records, budgets, accounting and report-
ing systems (BARS) as prescribed by the State Auditor pursuant to RCW
43.09.200 and 43.09.230.

1 SECTION II. ADMINISTRATION.
2 The Director of Public Works shall have full authority and responsi-
3 bi.lity for the operation of the Equipment Rental Division under the direction
4 of the County Executive. The Director shall be. responsible for establishing
5 rental rates to be charged by piece of equipment to the using or assigned
6 department.
7 SECTION III. RATES.
8 Rates for the rental of equipment owned by the Fund shall be as
9 prescribed by BARS to cover all costs of maintenance and repair, and parts and
10 supplies consumed in the operation, maintenance and administration of the equip -
11 ment, and the future replacement thereof. The rates shall be determined by the
12 Director of Public Works, with the concurrence of the County Executive, and
13 shall be subject to annual review by the County Council.
14 SECTION IV. TRANSFER OF MOTOR POOL, DEPARTMENTAL FUNDS AND EQUIPMENT.
15 On January 1, 1984, all assets of the Motor Pool shall be transferred
16 to the Equipment Rental Division and the funds of the Vehicle Revolving Fund
17 shall be transferred to the Equipment Rental and Revolving Fund. Funds received
18 shall be reserved for replacement of equipment and, as of January 1, 1984,
19 rental rates shall continue to be collected by the Director in accordance with
20 this ordinance. Any funds transferred to the E.R. &R. Fund by departments shall
21 be used to replace any equipment of such department; provided, that the depart -
22 ment or departments shall budget for the replacement of said vehicle within
23 their respective budgets. Said amount shall be budgeted for the total replace -
24 ment of vehicle or vehicles minus the amount in the transfer to the E.R. &R. Fund.
25 On or before July 31 of the year preceeding the next budget year; the Director
26 shall determine the value of each department's equipment fleet as of January 1st
27 of the base year calculated upon the original purchase price of equipment in
28 such fleet. Where an original price is not available, the Director's estimate
29 of the original price shall be used.
30 In the event that the requirements of a department for needed replace -
31 ment of its equipment cannot be satisfied from the amount available from the
32.1 fund as calculated above, the director of the department or the Director of

I Public Works, with the approval of the County Executive, may apply to the County
2 Council for authority to expend additional funds for the replacement of equip -
3 ment. Replacement of any equipment may be paid in full or in part from any
4 available sources.
5 The Director of Public Works shall determine, or cause to be deter -
6 mined, the rental to be charged on all replacement or additional equipment
7 purchased pursuant to the foregoing paragraph and immediately charge and collect
8 such rental from the renting department. Said rental rates shall be in accor-
9 dance with and not less than the annual rates approved by the County Executive
10 and reviewed by the County Council.
11 SECTION V. USES OF FUND AND CHARGES.
12 The County Council may, from time to time, place monies in the fund
13 from any sources lawfully available to it and may transfer equipment, materials
14 and supplies of any office or department to the Equipment Rental and Revolving
15 Fund with or without charge consistent with RCW 43.09.210. Charges for the
16 rental of equipment and for providing materials, supplies and services to any
17 County office or department shall be paid into the fund. Proceeds received
18 from other governmental agencies for similar charges and for the sale of equipmec
19 or other personal property owned by the Equipment Rental and Revolving Fund,
20 which is no longer of any value to or need by the County, shall be placed in the
21 fund as received. Money accumulated in the Equipment Rental and Revolving
22 Fund shall be retained therein from year to year and shall be used only for the
23 purpose stated herein and shall be subject to budgetary regulations in Chapter
24 36.40 RCW. All services rendered by or property transferred from one department,
25 public improvement, and undertaking, institution or public service industry to
26 another shall be paid for at its true and full value by the department, public
27 improvement, undertaking, institution or public service industry receiving the
28 same, and no department, public improvement, undertaking, institution or public
29 service industry shall benefit in any financial amount whatsoever by an appropri
30 tion or fund made for the support of another. Monies or property for any
31 operating fund, department, division or agency of county government transferred
32 to the Equipment Rental and Revolving Fund may not be used for the benefit of

11 any other operating fund, department, division or agency of county government.
SECTION VI. CAPITAL ASSETS.
The Whatcom County Council hereby dissolves the County Motor Pool and
directs that all assets as shown on Exhibit A of this ordinance shall be trans-
ferred to the Equipment Rental and Revolving Fund as of January 1, 1984, and
directs departments, offices or agencies, as authorized herein or by resolution
of the County Council, to provide for purchase or replacement equipment, if re-
quired. Provided that the County Treasurer's vehicles, purchased with the
Treasurer's 0 &M funds, shall remain at the disposal of the Treasurer's Office,
and all costs for these vehicles shall come from the Treasurer's 0 &M dollars or
the Treasurer's annual budget. Provided further, that the Treasurer's vehicles
purchased with Treasurer's 0 &M funds shall be utilized exclusively for the
Treasurer's office and all maintenance and repair on said vehicles shall be from
the Treasurer's budget.
