HomeMy WebLinkAboutord1983-0551 2 3 4 5 fi 7 8 9 10 11 12 13 14 15 if 17 18 19 i 20 21 22 23 24 25 26 27 28 29 30 31 32 DATE: June 16, 1983 INTRODUCED BY: Hansey PROPOSED BY: Hanseyy ORDINANCE NO. 83 -55 AN ORDINANCE AMENDING WHATCOM COUNTY CODE SECTION 1.08.060 PROVIDING FOR PROCEDURES AS TO THE FORM OF PETITIONS FOR INITIATIVES AND REFERENDUMS WHEREAS, the Whatcom County Charter authorizes the initiative and referendum by the citizens of Whatcom County, and WHEREAS, the County Council is responsible under the Charter to provide procedures to follow in the preparation and filing of initiative and referendum, and WHEREAS, there is presently no direction from the County Council as to the size of the petition form to be used by those desiring to initiate an initiative or referendum and those citizens are being required to utilize a petition form 11 x 17 inches in size which is exceedingly expensive and has a dampening effect to the citizens who may wish to file an initiative or referendum due to the cost, and WHEREAS, the Whatcom County Auditor has requested the County Council to clarify this requirement; NOW, THEREFORE, BE IT ORDAINED that the Whatcom County Code be amended as follows: 1.08.020 Definitions. B. "Measure" means legislative enactment, statute, or law (used to refer to the complete and appropriate text of an ordinance or act requested. 1.08.050 Preparation and Filin Any legal voter, or organization of legal voters of Whatcom County, may prepare and file an initiative, mini - initiative, or referendum measure with the county auditor, who within five (5) days excluding Saturday, Sunday and holidays, shall confer with the petitioners to review whether the proposed measure is deficient as to form or style the petitioner(s) shall be so advised by the Auditor to allow correction to be made before filing. Each petition, at the time of circulating, signing and regis- tering, shall consist of not more than one sheet and not more than twenty signatures on numbered lines on each sheet with the prescribed title, except the mini - initiative which does not require a ballot title, and a full, true and correct copy of the proposed measure referred to therein printed. which may be printed on the reverse side. B. The persons proposing the measure may prepare blank petitions and cause them to be printed upon single sheets of paper of good writing quality (including, but not limited to newsprint) not less than 8 1/2 inches nor more than 11 inches in width and not less than 11 inches nor more than'14 inches in length with a margin of one inch at the top for binding. C. The Auditor shall give the proposed initiative or referendum, except a mini - initiative, a number which shall thereafter be the identifying number for the measure and refer it to the Prosecuting Attorney. D. Petition forms for submission to the people for their approval or rejection at the next ensuing general election, shall be substantially in the following form: WARNING: Every person who signs this petition with any other than his true name, or who knowingly signs more than one of these petitions, or who signs this petition when he is not a legal voter, or who make herein any false statements, shall be punished by fine or imprisonment or both. TO: INITIATIVE (OR REFERENDUM) PETITION FOR SUBMISSION TO THE VOTERS OF WHATCOM CUONTY. , Auditor of Whatcom County. We, the undersigned citizens of Whatcom County and legal voters, respectfully direct that the proposed measure known as County Initiative (or Referendum) Measure No. entitled (insert here the established ballot title of the measure), a full, true and correct copy of which is printed hereon, shall be submitted to the legal voters of Whatcom County for their approval'or rejection at the general election to be held on the day of , 19 ; and each of us, as signers of this petition, state: I have personally signed this petition, I am a legal voter of Whatcom County, State of Washington, and my address is correctly stated on this petition.
