ORDINANCE NO. 83 -31 AN ORDINANCE AMENDING TITLE 20 W.C.C., THE OFFICIAL WHATCOM COUNTY ZONING ORDINANCE, TO ALLOW TEMPORARY DWELLINGS FOR DISABLED FAMILY MEMBERS AS A CONDITIONAL USE IN RESIDENTIAL DISTRICTS WHEREAS, it has been determined that there is a public need to allow.for the placement of temporary dwellings on lots of record for disabled family members,needing care and assistance; and, WHEREAS, the Official Whatcom County Zoning Ordinance'does not provide for said use; and, WHEREAS, the Planning Commission has reviewed this matter, conducted a public hearing and prepared Findings, Reasons and 'ioti recommending adoption of an amendment to Title 20 W.C.C. allowing for such dwellings; arid, WHEREAS, the Whatcom County SEPA Official has issued a Final Declaration of Non- Significance dated February 10,, 1983; NOW, THEREFORE, BE IT ORDAINED BY THE WHATCOM COUNTY COUNCIL that Title 20, the Official Wh,atcom County.Zoning Ordinance, be and hereby is amended to:allow for temporary dwellings for disabled family members in residential districts as set forth in Exhibit "A ". .APPROVED this 21st day of April , 1983. DI S ND , Deputy Prosecuting Attorney Cou ty Executives'= Published and April 29,'3: - This ordinance becomes effective on May 2, 1983 "� _ 4 EXHIBIT "A" AS AMENDED BY COUNCIL - APRIL 21, 1983 NOTE: The following amendment to Title 20 W.C.C. shall be inserted as, a conditional use in all residential districts: A manufactured home of 600 square feet or less, a fully serviced travel trailer or motor home, to provide temporary dwelling space for family members who, due to professionally documented physical or mental disorders, or risks of such disorders require daily supervision and care where such care is being provided by members of the family who reside on the property; provided: 1. Such conditional use shall-only be permitted on fully serviced parcels on which applicant can meet setback, ingress, egress, height restrictions, and lot coverage requirements; 2. The temporary home shall be connected to an approved water and adequate capacity sewage disposal system; 3. When the need for daily care no longer becomes . necessary the temporary home shall be removed; 4. The permit shall be valid for a one -year period. Said permit may be extended on a yearly basis provided that an affidavit is furnished by the family member providing the supervision and care to the disabled person that the cir- cumstances requiring the original permit remain in effect.
