WHEREAS, pursuant to Resolution No. 83 -14 of the County Council of Whatcom County (the "Council ") , adopted on March 17 , 1983, a public hearipg on confirmation of the final assessment roll for Whatcom County toad Improvement District No. 5 ( "RID 5 ") was held on April 21, 1983, at 7:30 p.m.; and WHEREAS, notice of the public hearing on confirmation of the final assessment roll was duly published, and mailed to each owner of property within RID ,5 pursuant to the requirements of RCW 36.88.090; and WHEREAS, the Council, sitting as a board of equalization for such purpose, gave due consideration to the final assessment' roll for RID 5 and all timely written objections filed with respect thereto; and WHEREAS, it is deemed necessary and advisable that the final assessment roll for iRID 5 be'approved and confirmed; NOW, THEREFORE, BE IT ORDAINED, by the County Council of Whatcom County, Washington, as. follows: Section 1. The Council, sitting as a board of equalization and having made all, revisions to the roll it deems necessary, hereby finds and determines that the final assessment roll for RID 5 is just and equitable,. and that no assessment against property within RID 5 is greater than the special benefits to be derived from the improvements. Accordingly, the final assessment roll, in the total amount of $191,000.00 , is hereby approved and confirmed, and the assessments,set forth therein are hereby levied Ordinance - 1 I against each lot, tract and parcel of property described in said 2 roll. 3 Section 2. Thq Clerk of the Council is hereby directed to 4 place in the hands of the Whatcom' County Treasurer for collection 5 the final assessment roll. for RID .5, bearing such revisions as the 6 Council has made thereto. Upon such placement, the amount of each 7 assessment set forth,therein, together with any interest accrued or 8 penalty imposed from time to time thereon, shall become a lien 9 against the property so assessed. Said lien shall be paramount and 10 superior to any other lien or encumbrance whatsoever, theretofore 1.1 or thereafter created, except a lien for general taxes. 12 Section 3. Upon receipt of the final assessment roll for RID 13 5, the Whatcom County Treasurer is hereby directed to publish 14 notice at the times and in the manner required by RCW 36.88.270, 15 stating that said roll is in his hands for collection and that such 16 assessments or any portion thereof may be paid at any time within 17 thirty (30) days from the date, of the first publication of said 18 notice, without penalty, interest or costs. 19 Section 4. The amount of any assessment, or any portion 20 thereof, against property in RID 5 not. paid within the thirty day 21 period from the date of the first publication of the County 22 Treasurer's notice ghall be payable in ten (10) equal annual 23 installments, together with interest on the diminishing principal 24 balance thereof at a rate to be determined by the Council. 25 Interest shall commence on the thirtieth day following first 26 publication of such notice. The first installment shall become due 27 and payable one ye4r from the expiration of the thirty day 26 prepayment period. Annual installments, including interest and any 29 penalty, shall be paid in full when due, and no partial payments 30 shall be accepted by the County Treasurer. 31 Section 5. Any installment not paid.when due shall thereupon 32 become delinquent. All delinquent installments shall be subject to Ordinance - 2 1 2 3 4 5 6 7 S 9 10 11 12 131 14 15 V 17 18 19 20 21 22 23 24 I 25 26 27 28 29 30 31 32 a penalty equal to ten percent (10 %) per annum of the amount of th installment, including interest, from the date of the delinquenc until paid. Section 6. The lien of any assessment may be discharged a any time after the thirty day prepayment period herein provided fo by payment of the entire principal amount of the assessmen remaining, unpaid together with interest thereon to the due date o the next installment.
