4 AN ORDIWISICE confirming, ratifying and approving the
formation of Whatcan County Road Improvement District. No. 5

6 MEW -AS, by Resolutiop No. 81 -31, adopted on August 6, 1981, the Whatcom,
7 county Council (the "Council ") initiated, the formation of Whatcom County Read
8 Improvement District No. 5 (. "RID 511 set the date for a public hearing thereon,
9 and provided for the mailing of ballots regarding such formation to owners of
10 property within the proposed.. RID; and
11 WHEREAS, pursuant to Resolution No-..81-31, the public hearing on the form
-
12 aiton.of RID 5 was held on October 15, 1981; and
13 Tom' a majority of the votes cast approved the formation of RID 5,
14 with each.property. owner allowed one vote for each full collar of the estimated
15 assessment against his property as determined by the preliminary assessment
16 roll; and
17 .hMWAS, based on the results of'such balloting, the Council adopted
18 Resolution No. 81 -58 on Depember 3, 1981, creating RID 5; and
WHEREAS, it is deemed necessary and advisable that the Council confirm,
19
ratify and approve the formation of RID 5 pursuant to Resolution No. 81 -58 by
20
ordinance;

Section 1.- Findings. The Council hereby confirms that,,after due
23
consideration, it found the plan of improvements for RID 5 to be feasible,
24
and that the benefits to by derived therefrom by the property within RID 5
25
would exceed the costs and expense of the formation of the district and the
26
construction of the improvw.mts .

Section 2. 'Establishment of-RID 5. The formation of Whatcom. County road
28.
Improvement District No. 5 and the ordering of the improvements by Resolution
29
No. 81-58 of the Council is hereby confirmed, ratified and approved.

Section 3. Nature and E� t of Tmprovements. The nature and territorial
31
extent of the improvements consist of the construction to Whatcom county stand -
32 ands of Coronado Avenue between Fremont Avenue and Lewis Avenue, and. Lewis
Avenue and Colurbus Avenue between Beecher Avenue and Coronado Avenue.

1 Section 4. Boundaries of'RID 5. The boundaries of RID 5 are set forth
2 by legal description in Exhibit A which is attached hereto and incorporated
3 herein by this reference.
4 Section 5. Method'of Assessment. The method of assessment shall be based
5 upon the square footage of the properties assessed. The estimated cost of the
6. improvements shall be assessed in accordance with the following formula:

Improvement per square foot

Lewis Avenue 80%.of cost @ $.27874 per square foot
9 20% of cost @ $.15485 per square foot
10 Columbus Avenue $.34711 per square foot
11 Coronado Avenue $.07854 per square foot
12 All property within RID 5 shall be assessed for the cost of the improve -
13 ments to Coronado Avenue. Only property abutting Lewis Avenue shall be assessed
14 for the cost of the improvements.to Lewis Avenue, and only property abutting
15 Columbus Avenue shall be assessed for the cost of improvements to Columbus
16 Avenue.
17 The preliminary assessment roll is on file with the Clerk of the Council.
Section 6. Estimated Cost. The estimated cost of the improvements, all
18
19 of which shall be assessed against the properties in RID 5, is hereby declared
20 to be $190,000.
21 Section 7. Results of Balloting. Ballots in favor of the formation of
RID 5 representing $58,104,00 of estimated assessments were received by the
22
County. Ballots opposed tq the formation of RID 5 representing $33,523.00 of
23
estimated assessments were also received. 'A majority of the votes cost thus
24
approved the creation of RID 5 and the construction of the improvements.

Section 8. Effective Date. This - ordinance shall take effect ten (10)
26
days from and after its passage and approval as provided in Section 2.30 of the
27
Home Rule Charter for Mateom County.

Legal Description of the Boun4ary of Proposed R.I.D. No. 5.
A portion of Section 35, Township 38 North, Range 3 East., W.M. in Whatcom
County, Washington, described as follows:.
Beginning at the point of intersection of the centerlines of Fremont Avenue and
Coronado Avenue; thence east Along the centerline of Fremont Avenue, 130 feet;
thence South, along the exten4ed east line of Lot 11, Block 12 of the Amended
Plat of Geneva, 165 feet to the centerline of the alley in said block; thence
east along the centerline of the said alley to the centerline of Livingston
Avenue; thence south along the centerline of Livingston Avenue to the south
right of way line of Lookout Avenue; thence west along the south right of way
line of Lookout Avenue to the centerline of Coronado Avenue; thence continuing
west along the centerline of Lookout Avenue in the Plat of South Geneva on Lake
Whatcom to the centerline of bake Louise Road (Co. Rd. No. 557); thence north-
westerly along the centerline of Lake Louise Road to the centerline of Beecher
Avenue; thence north along the centerline of Beecher Avenue to the centerline
of vacated LaSalle Street; thence east along the centerline of vacated LaSalle
Street to the extension of the east line.of the west 480 feet of the Orchard
Tract in said Plat of South Geneva; thence north along said extension and said
east line to the centerline of Fremont Avenue; thence east along the centerline.
of Fremont Avenue to the point of beginning.
Note: Portions of the alley And Livingston Avenue abutting Block 12 in the Amended
Plat of Geneva have been vacated.
