HomeMy WebLinkAboutord1983-0211 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 DATE March 3, 1983 PROPOSED BY INTRODUCED BY ORDINANCE NO. 83 -21 Public Works Department AN ORDINANCE AMENDING ORDINANCE 82 -85, AN ORDINANCE OF THE COUNTY COUNCIL OF WFiATCOM COUNTY AUTHORIZING THE ACQUISITION, CONSTRUCTION AND INSTALLATION OF THE EXPOSITION BUILDING ON THE GROUNDS OF THE NORTH- WEST WASHINGTON FAIR, AND THE - REPAIR AND REPLACEMENT OF COUNTY ROADS AND DRAINAGE FACILITIES; PROVIDING FOR THE ISSUANCE AND SALE OF LIMITED TAX LEVY GENERAL OBLIGATION BONDS OF THE COUNTY IN THE PRINCIPAL SUM OF $1,300,000; PROVIDING THE DATE, FORM, TERMS AND MATURITIES OF SAID BONDS; PROVIDING FOR THE ANNUAL LEVY OF TAXES TO PAY THE PRINCIPAL OF AND INTEREST ON SAID BONDS; AND PROVIDING.FOR THE SALE THEREOF BY MODIFYING SECTION 2.B. ENTITLED "ROAD IMPROVEMENTS." WHEREAS, Whatcom County Ordinance No. 82 -85, Section 2.B., provides for repairing and restoring certain roads owned by aqd located within Whatcom (County; and WHEREAS, the County Executive is authorized to substitute one or more road capital improvement projects for those specified in.Section 2.B., subject to ratification of the County Council; and WHEREAS, the County Executive deems it necessary to substitute by Iadding to and deleting from Section 2.B., due to the damage to the roads, bridges and road - related drainage facilities caused by the storm on January 10th; and WHEREAS, in order to provide the monies required therefor it is deemed necessary and advisable by the County Council that Section 2.B. be amended, and to clarify which projects will be deleted, if necessary, to provide the matching money for the disaster projects as requested by the County Executive and to , reflect the prioritization of each project as listed herein; NOW, THEREFORE, BE IT ORDAINED by the County Council of Whatcom County, Washington, that Ordinance 82 -85 Section 2.5. is hereby amended to read as follows: Amending Section 2.B. entitled "Road Improvements ": The County shall construct, repair and restore the following roads owned by and located within Whatcom County based on the following order of priority and estimated cost: ORDINANCE - 1. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 BOND PROJECTS - 1983. 1. Reese Hill $ 60,000 2. South Pass Road 100,000 3. Kendall /Wheeler Road 250,000 4. Beach Avenue 7,000 5. West Shore Road 50,000 6. Lummi Shore Road 130,000 7. North Nugent Road 110,000 8. Hannegan Road 110,000 BE IT FURTHER ORDAINED, that the County Executive is hereby authorized to utilize the Road Construction Bond Fund revenues for the purpose of construct- ing, repairing and restoring roads, bridges and road - related drainage facilities as prioritized and specified herein; and for the purpose of making payment for the balance of costs on other flood damaged roads, bridges and road - related drainage facilities in Exhibit A attached hereto that have been approved for matching funds by the Federal Emergency Management Agency (F.E.M.A.). The County Executive shall.consider the balance of payments on Federally funded flood damage construction projects as first in order of priority and, if necessary the County Executive shall delete from the bond project priority list beginning with project No. 8.
