HomeMy WebLinkAboutord1983-0171 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 DATE: February 17, 1983 INTRODUCED BY: PROPOSED BY: Johnson ORDINANCE NO. 83 -17 AN ORDINANCE IN THE MATTER OF AMENDING THE DEFINITION OF THE TERM "FRONT YARD" SET FORTH IN THE WHATCOM COUNTY INTERIM ZONING ORDINANCE, SECTION 2.24.840 AND \ IN THE NEW COUNTY ZONING ORDINANCE, TITLE 20, SECTION 20.97.450 WHEREAS, the definition of the term "front yard" con- tained in the County Interim Zoning Ordinance and in the new County Zoning Ordinance, Title 20, is in need of clarification; and, WHEREAS, amendment of the present definition will pro- vide for better administration of the zoning ordinances; NOW, THEREFORE, BE IT ORDAINED BY THE WHATCOM COUNTY COUNCIL as follows: 1. That Section 2.24.840 of the Interim Zoning Ordinance shall be and is hereby amended as set forth in Exhibit "A" which is attached hereto; 2. That Section 20.97.450 of Title 20, the new County Zoning Ordinance, shall be and hereby is amended as set forth in Exhibit "B" which is attached hereto. APPROVED this loth day of March 1983. An open space on a lot, between a the road right- of -wdy (front property line) and the bulldiR -;- elesest to the Fead requisite minimum front yard setback line. The requisite front yard setback area must be open from side -to- side of the lot, provided that uncovered patios, driveways, walkways, vegetation, pools, recre- ation equipment and fences or walls up to four (4) feet in height may, subject to the limi- tations of 2.24.628 7618 600.620, be placed in the this front yard setback area. Where a lot lies at the corner of two or-more roads, it shall have a front yard setback area extending back from each road right -of -way. If the width of the road right -of -way is not known, it shall be assumed to be sixty (60) feet. All front yard setback measurements are minimum require- ments. And, further provided that fences, walls, or vegetative hedges located within this front yard setback area may exceed four (4) feet in height, to a maximum of six (6) feet, only if: (1) They do not obstruct or impair visual corridors of surrounding properties and sight distances of vehicular traffic; (2) They are adjudged to be necessary in order to provide security and privacy to the particular use activity by reason of - the property's immediate location next to public access areas; or - its facilities and amenities which are both attractive to the general public, 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 and intended for the exclusive use of its inhabitants and /or patrons; or (3) They are deemed necessary for the pro- tection of the public heaZth, safety, and general welfare. 1 2 3 4 5 6 7 8 9' I 10 11 12 13 14 15 16 17 18 19 20 21 72 23 24 25 26 27 28 29 30 31 32 EXHIBIT "B" AMENDMENT TO SECTION 20.97.450 TITLE 20 .450 YARD FRONT. An open space on a lot, between -& the road right -of -way (front property line) and the building eiesest to the read requisite minimum front yard setback line. The requisite front yard setback area must be open from side -to -side of the lot, provided that uncovered patios, driveways, walkways, vegetation, pools, recreation equipment and fences and walls up to four (4) feet in height may be placed in the this front yard -e- setback area, subject to the limitations of WCC 20.80.735 400. Where a lot lies at the corner of two or more roads, it shall have a front yard setback area extending back from each road right -of -way. If the exact 1.6cation of the right - of -way line is not known, it shall be assumed that the improved traveling surface of the road is in the center of the road right -of -way. If. the width of the road right -of -way is not known, it shall be assumed to be sixty (.60) feet. All front yard setback measurements are minimum requirements.
