ORDINANCE NO.83 -13
AN ORDINANCE AMENDING SECTION 8.44
OF THE WHATCOM COUNTY SUBDIVISION
REGULATIONS FOR THE PURPOSE OF
EXPEDITING SHORT SUBDIVISION VARIANCE
REQUESTS.
WHEREAS, Section 8.44 of the Whatcom County Subdivision
Regulations presently requires the Subdivision Technical Committee
to refer all short subdivision variance requests to the Whatcom
County Council; and,
WHEREAS, this referral process may unduly prolong approva
of short subdivision applications; and,
WHEREAS, the Whatcom County Council's Planning and
Development Committee submitted proposed revisions of Section 8.44
to the Planning Commission for review and comment; and,
WHEREAS, the Planning Commission, following review, has
recommended adoption of the proposed revisions;
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County
Council that Section 8.44 of the Whatcom County Subdivision Regu-
lations be and hereby is amended as set forth in Exhibit "A"
which is annexed hereto.

Section 8.44.030 SHORT SUBDIVISION VARIANCES
Where- the- �eehatea�- @ammtttee -finds A Variance to
the regulations of this ordinance may be granted by the Technical
Committee upon a finding that a special or unusual circumstnace
exists or that extraordinary hardship may result from strict
compliance with the requirements for short subdivisions; and that
justice could be done and the public interest secured by the grant-
ing of a suitable variance,t- eha��- refer- the- atatter -te -the

Section-8.44.040 CONDITIONS
1. In granting subdivision variances and modifications,
the County Council and Hearing Examiner may require such conditions
as will in its judgment secure substantially the objectives of the
standards or requirements so varied and modified.
2. In granting short p }at subdivision variances, the
