ORDINANCE NO. 84 -96
AN ORDINANCE. AMENDING CHAPTER 3.08
OF THE WHATCOM COUNTY CODE FOR.THE
PURPOSE OF ESTABLISHING I)ARAMETERS
FOR BID REQUIREMENTS.

WHEREAS, the Revised Code of Washington Section 36.82.130
requires competitive bidding for purchase of equipment, but not for
repairs to equipment; and,
WHEREAS, when the Public Works Department is in the
process of completing a job and an expensive piece of equipment
breaks, the bidding requirement of the present ordinance creates a
cumbersome and expensive process ;. and,
WHEREAS, the required bidding on repair work creates
sixty (60) days of down time on the equipment and requires the
County to enter a leasing agreement for equipment to replace that
which is down, thereby creating an added cost to the County; and,
WHEREAS, the County as a whole would benefit financially
if the repairs to necessary equipment was not required to be put
out to bid; and,
WHEREAS, the Revised Code of Washington, Section 36.34.130
provides for the transfer of inter - governmental property without the
requirement of bidding procedures; and,
WHEREAS, the Ordinance in its present form would require
the bidding process to occur before inter - governmental transfers
could be made; and,
WHEREAS, this effectively prohibits Whatcom County from
making any inter - governmental purchases in that the selling agency
does not hold the property for the period of time required to go
through the bidding process; and,
WHEREAS, the people of Whatcom County would be benefited
1by being able to take advantage of inter - governmental transfers; and

WHEREAS, it is deemed advisable to amend Chapter 3.08 of
the Whatcom County Code to create exemptions from the bidding re-
quirements for repairs to necessary equipment and for inter -gover
transfers;
NOW, THEREFORE, BE IT ORDAINED that Chapter 3.08.180 of
the Whatcom County Code be and hereby is amended as follows:
3.08.180 Bids required for contracts, leases
or purchases.exceeding Three Thousand Five
Hundred Dollars ($3,500.00) or more -- .
professional service contracts, repairs to
necessary equipment, and inter - governmental
transfers excluded.
(1) No contract, lease, or purchase involving
funds of Three Thousand Five Hundred Dollars
($3,500.00) or more shall be entered into
until after bids have been submitted in response
to specifications and invitations to bid;
provided, however, that.any bid exceeding
Ten Thousand Dollars ($10,000.00) shall
be submitted to the Council for approval;
the provisions of this section shall not.
apply to contracts for professional services;
provided, however, that any contract exceeding
Ten Thousand Dollars ($10,000.00) shall be
submitted to the Council for approval.

(2) All expenditures of County Agencies of
Five Thousand Dollars ($5,000.00) or more
for professional consulting service shall
be made upon a call for bids or proposals,
with selections being made upon consideration
of qualifications and costs, except in the
case of.emergencies declared by the County
Executive, or the acquisition of such services
from other public entities, or when the County
Council, upon the recommendation of the County
Executive, finds that a waiver of the bid
requirement will be in the best interest of
Whatcom County. "Professional consulting
services" includes, but is not limited to,
services from lawyers, architects, engineers,
labor relations consultants, accountants,
physicians, nurses, financial analysts;
management consultants, and computer specialists.
In regard to contracts where architectural and
engineering services, this section shall
supplement the provisions of RCW Chapter 39.80
and not be in lieu thereof. The Countv Executive
may issue executive orders to carry out the pro -
visions of this subsection and such orders shall
be binding upon all executive and administrative
departments, agencies, and officers.

(3) Expenditures for architectural, professional,
and engineering services shall . also be made
in compliance with Chapter 39.80. RCW.
(4) Repairs for less than Ten Thousand Dollars
($10,000.00) on equipment necessary to
complete a project and inter - governmental
transfers of property shall not be required
to go through competitive bidding. However,
should either the repair or the property
transfer be for Ten Thousand Dollars ($10,000.00)
or more, it shall require Council approval.
