5 AN ORDINANCE ADOPTING, BY REFERENCE, THE 1982 EDITION OF
THE UNIFORM PLUMBING CODE, EXCEPT AS MODIFIED HEREIN, AND
6 INSTALLATION STANDARDS AND.CERTAIN APPENDICIES PUBLISHED
BY THE INTERNATIONAL ASSOCIATION OF PLUMBING AND MECHANICAL
7 OFFICIALS AND IN ACCORDANCE WITH THE PROVISIONS OF THE
STATE BUILDING CODE ACT, R.C.W. CHAPTER 19.27 AND REPEALING
8 ORDINANCE NO. 79 -6.9 AND OTHER RELATED ORDINANCES IN CONFLICT
HEREWITH.

i0 WHEREAS, R.C.W. 19.27.040 provides that the governing body of each
11 county is authorized to amend the State Building Code as it applies within its
�! 12 jurisdiction in all, such respects, as shall be not less than the minimum per -
13 formance standards and objectives enumerated in said chapter; and
14 WHEREAS, THE 1982 Edition of the Uniform Plumbing Code, Installation
15 Standards, and certain appendicies thereto, meet or exceed the minimum per -
16 formance standards and objectives of R.C.W. Chapter 19.27; and
17 WHEREAS, adoption of the above codes, with certain modifications, will
18 promote the health, safety and welfare-of the general public;
19 NOW, THEREFORE, THE WHATCOM COUNTY COUNCIL DOES ORDAIN:
20 Section 1. Purpose /Adopted, This ordinance is enacted as an exer-
21 cise of the police power of the County for the benefit of the public at large.
22 It is not intended to create a special relationship with any individual, or
23 individuals, nor to identify and protect any particular class of persons. The
24 purpose of this ordinance is to provide minimum standards to safeguard life or
25 limb, health or property, and public welfare, by regulating and controlling
26 building construction and related work thereto. It is not the intent of this
27 ordinance to impose liability upon the County for failure to perform any
28 discretionary act. Rather, it is the intent of this ordinance to place the
29 obligation of complying with its requirements upon the owner and /or contrac-
30 tor, Nothing contained in this ordinance shall be construed to relieve from
31 or to lessen the responsibility or liability of any person or persons for

I injury or damage to persons or property caused by or resulting from any defect
2 of any nature in any construction work performed by said person or any
3 construction equipment owned, controlled, operated or used by the contractor;
4 nor shall Whatcom County, or any officer, agent, or employee thereof incur or
g 11be held as as any liability by reason or in consequence of any per -
6 mission, certificate of inspection, inspection or approval authorized herein,
7 or issued or given as herein provided, or by reasons or consequence of any
8 things done or acts performed pursuant to the provisions of this ordinance.
9 The Uniform Plumbing Code, 1982 Edition, Installation Standards, and
10 certain appendicies, except as modified herein, shall be in full force in
11 Whatcom County, upon adoption of this ordinance.
12 Section 2. Administrative Authority. Section 20.1 of the Uniform
13 Plumbing Code, 1982 Edition, is hereby amended to read as follows:
14 Section 20.1. The Building Official is hereby authorized and
15 directed to enforce all provisions of this code. For such purpose, he shall
16 have the powers of a law enforcement officer. Wherever the term Administrative
17 Authority is used in this code, it shall be construed to mean the County
18 Building Official /Director of Public Works.
19 Section 3. Violations and Penalties. Section 20.3 of the Uniform
20 Plumbing Code, 1982 Edition, is hereby amended to read as follows:
21 Section 20.3. Any person, firm or corporation violating any
22 provision of this code shall be deemed guilty of a misdemeanor and, upon con -
23 viction thereof, shall be punishable by a fine not to exceed $500.00 or by
24 imprisonment in the County jail for not to exceed three months, or both fine
25 and imprisonment. Each separate day or any portion thereof, during which any
26 violation of this code occurs or continues, shall be deemed to constitute a
27 separate offense and, upon conviction thereof, shall be punishable as herein
28 provided. The issuance or granting of a permit or approval of plans and spe-
29 cifications shall not be deemed or construed to be a permit for, or an appro-
30 val of, any violation of any of the provisions of this code. No permit
31 presuming to give authority to violate or cancel the provisions of this code shall
32 be valid, except insofar as the work or use which it authorizes is lawful.

1 The issuance or granting of a permit or approval of plans shall
2 not prevent the Building Official /Director of Public Works from thereafter
3 requiring the correction of errors in said plans and specifications or from
4 preventing construction operations being carried on thereunder when in viola -
5 11tion of this code or of any other ordinance or from revoking any certificate
6 of approval when issued in error.
7 Every permit issued by the Building Official under the provi-
8 sions of this code shall expire by limitation and become null and void, if the
9 work authorized by such permit is not commenced within 180 days from date of
10 issuance of such permit, or if the work authorized by such permit is suspended
11 or abandoned at any time after the work is commenced for a period of 180
12 days. Before such work can be recommenced, a new permit shall be first obtained
13 to do so, and the fee therefor shall be one -half the amount required for a new
14 permit for such work, provided no changes have been made, or will be made in the
15 original plans and specifications for such work; and provided, further that such
16 suspension or abandonment has not exceeded six months.
17 Section 4. Cost of Permits. Section 20.7 of the Uniform Plumbing
18 Code, 1982 Edition, is hereby amended to read as follows:
19 Section 20.7. Cost of Permit. Every applicant for a permit to
20 do work regulated by this Code shall state in writing, on the application form
21 provided for that purpose, the character of work proposed to be done and the
22 amount and kind in connection therewith, together with such information, per -
23 tinent thereto, as may be required.
24 Such applicant shall pay for such permit, at the time of issuance,
25 a fee in accordance with the following schedule, and at the rate provided for
26 each classification shown herein.
27 Any person who shall commence any work for which a permit is
28 required by this Code, without first having obtained a permit therefor, shall,
29 if subsequently permitted to obtain a permit, pay double the permit fee fixed
30 by this section for such work in order to cover additional administrative
31 expenses incurred therefore; provided, however, that this provision shall
32 not apply to emergency work when it shall be proved to the satisfaction of the

I Administrative Authority that such work was urgently necessary and that it "was
2 not practical to obtain a permit therefor before commencement of the work. In
3 all such cases, a permit must be obtained as soon as it is practical to do so,
4 and if there be an unreasonable delay in obtaining such permit a double fee as
5 herein provided shall be charged.
6 For the purpose of this section, a sanitary plumbing outlet on
7 or to which a plumbing fixture or appliance may be set or attached shall be
$ construed to be a fixture. Fees for reconnection and retest of plumbing
9 systems in relocated buildings shall be based on the number of plumbing fix -
10 tures, gas systems, water heaters, or similar fixtures, systems, or appliances,
11 involved.
12 When interceptor traps or mobile home site traps are installed
13 at the same time as a building sewer on any lot, no sewer permit shall be
14 required for the connection of any such trap to an appropriate inlet fitting
15 provided in the building sewer by the permittees constructing such sewer.
16 When a permit has been obtained to connect an existing building
17 or existing work to the public sewer or to connect to a new private disposal
18 facility, backfilling of private sewage disposal facilities abandoned con -
19 Sequent to such connection is included in the permit.

Section 5. The Uniform Plumbing Code, 1982 Edition, is hereby
amended by adding thereto a new Section 20.15, to read as follows:
Section 20.15. Definitions.
(a) The definition of a Journeyman Plumber means any person
who has been issued a Certificate of Competency by the Department of Labor and
Industries as provided in RCW Chapter 18.106.
(b) The definition of plumbing contractor, as used in this
ordinance, is any person, firm or corporation who or which in the pursuit of
independent business undertakes to or offers to undertake or submits a bid to
contract or to carry on or engage in the business of plumbing in compliance
with RCW Chapter 18.21.
(c) Sewer or sewage disposal contractor is a person or firm
who may conduct, carry on, or engage in the business of installing, altering
or repairing sewers and private sewage disposal systems.
(d) Apprentice plumber is a person who labors at the trade
of plumbing as an employee under the direct supervision and in the immediate
presence of a plumbing contractor or journeyman.
(e) Administrative authority shall mean the Director of
Public Works /Building Official and /or his designee.

(f) Building Official shall mean the Director of Public

Section 6. The Uniform Plumbing Code, 1982 Edition, is hereby
amended by adding thereto a new Section 20.16 to read as follows:
Section 20.16. The public sewer may be considered as not being
available when such building or any exterior drainage facility connected thereto
lis located more than 150 feet from any proposed building or exterior drainage
facility on any lot of premises which abuts and is served by such public sewer.
It shall be the duty of the District Health Officer to enforce
connections to available public sewer. In no event shall a building sewer be
less than 4 inches in diameter. Building sewer or drainage pipe shall not be
run or laid in the same trench with water service pipes or any underground
water.pipes unless both of the following requirements are met: The bottom of
the water pipe at all points shall be at least 12 inches above the top of the
sewer line. The water pipe shall be placed on a solid shelf excavated on one
side of the common trench.
Section 7. Table A, Nonmetallic Piping, at page 23 of the 1982
Edition of the Uniform Plumbing Code, is hereby amended to include the
fol lowing:
Table A, Nonmetallic Piping. Bituminized fiber sewer pipe and
fittings shall not be allowed.
Section 8. Subsections 1005(b) and (f) of the 1982 Edition of the
Uniform Plumbing Code is hereby amended to read as follows:
1005(b). A fullway valve controlling all outlets shall be
installed on the discharge side of each water meter and on each unmetered
water supply. Water piping supplying more than one premises shall be equipped
with a separate fullway valve to each building, so arranged that -the water
supply can be turned on or off to any individual or separate building;
provided, however, that supply piping to a single family residence and
building accessory thereto, may be controlled on one valve. Such shut -off
valves shall be readily accessible at all times. Readily accessible shall
mean that the shut -off valve shall be located no farther than two feet away
from the crawl space opening, or shall be,located in the occupied part of the

min
premises or by a ground key type shut -off valve located no farther than two'
feet from the outside of the foundation line. A fullway valve shall be
installed on the discharge piping from water supply tanks at or near the tank.
A fullway valve shall be installed on the cold water supply pipe to each water
heater at or near the water heater. A fullway valve shall be installed for
each apartment or dwelling of more than one (1) family. In lieu of the main
supply shut -off in each apartment, individual shut -off valves may be provided
at each fixture.
1005(f). A single control valve shall be installed on a water
supply line ahead of any automatic metering valve which supplies a battery of
fixtures. The Building Official may allow a ground key stop and waste in
instances where a gate valve will not properly serve.
Section 9. Section 1008 of the 1982 Edition of the Uniform Plumbing
Code is hereby amended by adding thereto a new subsection (f) to read as
follows:
Water service pipes or any other underground water pipes shall
not be run or laid in the same trench with any electrical service wire unless
one of the following conditions is met:
1. A minimum horizontal separation of two feet is maintained at
all points along the line, or
2. All electrical wires are enclosed within a rigid metal conduit,]
or
3. All electrical wires are enclosed within a flexible conduit
which is encased in concrete.
Where water service pipes cross electrical service.wires, a
minimum vertical separation of one foot shall be maintained.
Section 10. The following chapters and sections of the 1982 Edition
of the Uniform Plumbing Code are hereby specifically deleted:

Section 11. Section 20.14 of the 1982 Edition of the Uniform
Plumbing Code is hereby amended to read as follows:
Section 20.14. Board of Appeals. Wherever the term "Board of
Appeals" is used, it shall mean the Whatcom County Appeals and Code Review
Board.
Section 12. Adoption by Reference. Pursuant to R.C.W. 36.32.120(1)
one copy of the code adopted by reference herein shall be filed for use and
examination by the public in the office of the Whatcom County Auditor prior to
the effective date of this ordinance.
Section 13. Ordinance No. 79 -69 and amendments thereto are hereby
repealed.
