ORDINANCE NO. 84 -41
AN ORDINANCE ADOPTING BY REFERENCE THE 1982 EDITION OF THE
UNIFORM MECHANICAL CODE, APPENDICIES AND STANDARDS THERETO
PUBLISHED BY THE INTERNATIONAL CONFERENCE OF BUILDING CODE
OFFICIALS AND THE INTERNATIONAL ASSOCIATION OF PLUMBING AND
MECHANICAL OFFICIALS, EXCEPT AS HEREIN MODIFIED, AND
REPEALING WHATCOM COUNTY ORDINANCE NO. 79 -69.
WHEREAS, R.C.W. 19.27.040 provides that the governing body of each
county is authorized to amend the State Building Code as it applies within
its jurisdiction in all such respects, as shall be not less than the minimum
performance standards and objectives enumerated in said chapter; and
WHEREAS, the 1982 Edition of the Uniform Mechanical Code, appendicies
and standards thereto, meet or exceed the minimum performance standards and
objectives of R.C.W. Chapter 19.27; and
WHEREAS, adoption of the above code, with certain modifications, will
promote the health, safety and welfare of the general public;
NOW, THEREFORE, THE WHATCOM COUNTY COUNCIL DOES ORDAIN:
Section 1. Purpose /Adopted. This ordinance is enacted as an exercise
of the police power of the County for the benefit of the public at large. It is
not intended to create a special relationship with any individual, or indivi-
duals, nor to identify and protect any particular class of persons. The purpose
of this ordinance is to provide minimum standards to safeguard life or limb,
health or property, and public welfare, by regulating and controlling building
construction and related work thereto. It is not the intent of this ordinance to
impose liability upon the County for failure to perform any discretionary act.
Rather, it is the intent of this ordinance to place the obligation of complying
with its requirements upon the owner and /or contractor. Nothing contained in
this ordinance shall be construed to relieve from or to lessen the respon-
sibility or liability of any person or persons for injury or damage to persons
or property caused by or resulting from any defect of any nature in any
construction work performed by said person or any construction equipment owned,

1 controlled, operated or used by the contractor; nor shall Whatcom County, or any
2 officer, agent, or employee thereof incur or be held as assuming any liability

by reason or in consequence of any permission,- certificate of inspection,
inspection or approval authorized herein, or issued or given as herein provided,
or by reasons or consequence of any things done or acts performed pursuant to
the provisions of this ordinance.
The Uniform Mechanical Code, 1982 Edition, Installation Standards, and
certain appendicies, except as modified herein, shall be in full force in
Whatcom County, upon adoption of this ordinance.
Section 2. Section 201(a) of the Uniform Mechanical Code, 1982
Edition, is hereby amended to read as follows:
Section 201(a). The Building Official is hereby authorized and
directed to enforce all provisions of this code. For such purpose, he shall
have the powers of a law enforcement officer. Wherever the term "Building
Official" is used in this code, it shall be construed to mean the County
Building Official /Director of Public Works.
Section 3. Section 203 of the 1982 Edition of the Uniform Mechanical
Code is hereby amended to read as follows:
Section 203. Board of Appeals. Wherever the term "Board of
Appeals" is used in this code, it shall be construed to mean the Whatcom County
Appeals and Code Review Board.
Section 4. Table 3 -A - Mechanical Permit Fees of the 1982 Edition of
the Uniform Mechanical Code, is hereby amended to read as follows:

Section 5. Section 506 of the Uniform Mechanical Code, 1982 Edition,
is hereby supplemented and amended to read as follows:
(a) Stable Pilots. All new or used gas- burning appliances whose
rated Btu input is 400,000 Btu's per hour or more shall be equipped with a stabl
pilot or pilots capable of providing safe ignition. The flame will be super-
vised by a flame safeguard which supervises the pilot at the point of ignition i
the main.burner, and it shall have response timing, de- energyzing the gas shut-
off device in not to exceed 5 seconds in case of flame failure. Provided,
however, in the case of listed equipment the safety pilot system and gas control
system used on such equipment will be accepted.

1 (b) Automatic Control Devices. All heating appliances shall be
2 1equipped with a listed device or devices which will shut off the fuel supply to
3 the main burner or burners in the event of pilot or ignition failure. In addi-
4 tion, liquefied petroleum gas air- burning heating appliances shall be equipped
5 11wi a listed automatic device or devices which will shut off the flow of gas to
6 the pilot in the event of ignition failure.
7 EXCEPTION: The listed shutoff devices shall not be required on
range or cooking tops, log lighters, lights or other open -
8 burner manually operated appliances, or listed appliances not
requiring such devices and specific industrial appliances as
9 approved by the Building Official.
10 All heating appliances whose manual fuel controls are not readily
11 accessible from the main portion of the building being heated shall be equipped
12 with remote controls.
13 All forced -air and gravity -type warm -air furnaces shall be equipped
14 with a listed air - outlet temperature limit control which cannot be set for tem-
15 peratures higher than 25O0F. Such controls shall be located in the bonnet or
16 plenum, within 2 feet of the discharge side of the heating element of gravity
17 furnaces or in accordance with the conditions of listing.
18 Electric duct heaters shall be equipped with an approved automatic
19 reset air outlet temperature limit control that will limit the outlet air tem-
20 perature to not more than 2000F. The electric elements of the heater shall be

21 equipped with fusible links or a manual reset temperature limit control that
22 will prevent outlet air temperature in excess of 25O0F.
23 Section 6. Subsection.7O4(6) of the Uniform Mechanical Code, 1982
24 Edition, is hereby supplemented and amended to read as follows:
25 Subsection 704(6). In any room used or designated to be used as
26 a bedroom, bathroom, closet or in any confined space with access only to such
27 room or space. The access to any furnace located in an attic or under -floor
28 crawl space may be through a closet. Exception: gas and heating appliances,
29 other than electrical heating appliances or fireplaces with adequate combustion,
30 11 shall not be installed in bedrooms, bathrooms, closets or confined spaces or
31 areas. Fuel- burning heating equipment with sealed combustion systems or
32 enclosed furnaces with a separate supply of combustion air will be allowed.
ORDINANCE - 5.
I Section 7. Subsection 2211(f) of the Uniform Mechanical Code, 1982
2 Edition, is hereby amended to read as follows:
3 Subsection 2211(f). A meter location shall be provided by the
4 consumer for the building or premises to be served. Said meter location to be
5 the exterior of the building on all buildings constructed after the effective
6 date of this ordinance and wherever possible in all existing buildings. The
7 location shall be such that the meter connections are easily accessible in order
8 that the meter may be read or changed. Where a gas meter must be located inside
9 a building, it shall be enclosed in a room or vault separate from any source of
10 ignition and this room or vault shall be vented to the outside air and subject
11 to approval of the inspector before installation. No gas meter shall be
12 hereafter installed under a stoop, stairway, show window, or porch or in an
13 unventilated or confined space.
14 Section 8. Section 204 of the Uniform Mechanical Code, 1982 Edition,
15 is hereby amended to read as follows:
16 Violations and Penalties. Any person, firm or corporation
i7 violating any provision of this ordinance or the code adopted by reference,
i8 shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be
i9 punishable by a fine not to exceed $500.00 or by imprisonment in the County jail
20 for not to exceed three months, or both fine and imprisonment. Each separate
21 day or any portion thereof, during which any violation of this code occurs or
22 continues, shall be deemed to constitute a separate offense and, upon conviction
23 thereof, shall be punishable as herein provided.
24 Section 9. Severability. If any section, subsection, sentence,
25 clause, phrase, or portion of this code or ordinance adopted herein is for any
26 reason held to be invalid or unconstitutional by the decision of a court of com-
27 petent jurisdiction, such decision shall not affect the validity of the
28 remaining portions of this ordinance or the code.
29 Section 10. Adoption by Reference. Pursuant to R.C.W. 36.32.120(7)
30 one copy of the code adopted by reference herein shall be filed for use and
31 examination by the public in the office of the Whatcom County Auditor prior to
32 the effective date of this ordinance.
Section 27. Ordinance No. 79 -69 and amendments thereto are hereby
repealed.
