WHEREAS, the 1984 Budget Ordinance, designated as Ordinance No. 83 -98, requires expenditures of County agencies of $5,000.00 or more for professional services to be made upon a call for bids or proposals, or as otherwise provided by law; and, ' WHEREAS, it is deemed advisable to amend Chapter 3.08 of the Whatcom County Code in order to incorporate the foregoing pro- visions of the Budget Ordinance and to create permanent standards for entering into contracts for professional services; NOW, THEREFORE, BE IT ORDAINED that Chapter 3.08 of the Whatcom County Code be and hereby is amended as follows: 3.08.180 Bids required for contracts, leases or purchases exceeding three thousand five hundred dollars or more -- professional service contracts excluded. (1) No contract, lease, or purchase involving funds of three thousand five hundred dollars or more shall be entered into until after bids have been submitted in response to specifications and invitations to bi•d; provided, however, that any bid exceeding ten thousand dollars shall be submitted to the council for approval. The provisions of this section shall not apply to con- tracts for professional services; provided, however, that any contract exceeding ten thousand dollars shall be submitted to the council for approval. ORDINANCE - 1 If 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 _17 18 19 20 21 22 23 24 25 26 27 ' 1128 29 30 31 32 (2) All expenditures of County agencies of $5'0 or more for professional consulting services shall be made upon a call for bids or proposals, with selections being made upon consideration of quali- fications and costs, except in the case of emergencies declared by the County Executive, or the acquisitionct such services from other 2ublic entitites, or when the County Council, upon the recommendation of the County Executive-, finds that a waiver of the bid requirement will be in the best interests of Whatcom County. "Professional consultinkservices" includes, but is not limited to, services from layers, archi- tects, engineers, labor relations consultants, accoun- tants nurses, financial analysts,r manage- ment consultants, and computer specialists. In regard to contracts for architectural and engineering service this section shall supplement the provisions of RCW Chapter 39.80 and not be in lieu thereof. The County Executive may issue executive orders to carry out the provisions of this subsection and such orders shall be binding upon all executive and administrative departments agencies, and officers. (3) Expenditures for architectural, professional, and engineering services shall also be made in compliance with Chapter 39.80 RCW.
