HomeMy WebLinkAboutord1984-0231 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 '17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 INTRODUCED BY: Consent PROPOSED BY: MUENSCHER DATE: February_ 16, 1984 1 ORDINANCE NO. 84 -23 AN ORDINANGE AMENDING TITLE 20 OF THB WHATCOM COUNTY CODE AND CLARIFYING THE SCOPE OF ORDINANCE NO. 83 -31 WHEREAS, Ordinance 83 -31 amends Title 20 of the Whatcom County Code to allow the placement of temporary dwellings to be conditionally approved on lots.of record for the purpose of facilitating provision of care and assistance to disabled family members; and WHEREAS, Ordinance 83 -31 omitted provision to make similar relief available to disabled persons who are resident propserty owners; and WHEREAS, the provisions to limit the size of the mobile home or trailer to 600 square feet on all parcels is unduly restrictive with respect to parcels over 2 acres in size. NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that Whatcom County Code Title 20 and Ordinance No. 83 -31 hereby are amended to include provisions of relief for disabled persons who are resident property owners and to include the provisions that on-lots 2 acres in size or larger, the 600 square foot size limit shall not apply, as set out in Exhibit "A" attached hereto. This grdinance effective on; IL INGTON EXHIBIT "A" Ordinance No. 84 -23 NOTE: The following amendment to Tile 20 Whatcom County Code shall be inserted as a conditional use in all residential districts: A manufactured home of 600 square feet or less, a fully serviced travel trailer or motor home, to provide: a) A temporary dwelling space for family members who, due to professionally documented physical or mental disorders, or risks of such disorders, require daily supervision and care where such care is provided by members of the family who reside on the property; or, b) A temporary dwelling space for a third party where the person requiring supervision and care in the manner described above is the resident owner of the subject property; PROVIDED, that 1. Such conditional use shall only be permitted on fully serviced parcels on which applicant can meet setback, ingress, egress, height restrictions, and lot coverage requirements; 2. The temporary home shall be connected to an approved water and adequate capacity sewage disposal system; 3. When the need for daily care no longer becomes necessary the temporary home shall be removed; 4. The permit shall be valued for a one -year period. Said permit may be extended on a yearly basis provided that an affidavit is furnished by the family- member- providing -the supervision- and - care -to- the- dienbied- pereen permittee affirming that the circumstances requiring the original permit remain in effect. 5. The 600 sq. ft. trailer /mobile home size limit all not apply on parcels 2 acres in size or larger.
