HomeMy WebLinkAboutord1984-004EN 2 3 4 5 6 7 8 9 10 11 12 13' 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 DATE: December 15, 1983 INTRODUCED BY: Roehl PROPOSED BY: Council Chair at request of Committee of the Whole ORDINANCE NO. 84 -4 AN ORDINANCE AMENDING ORDINANCE NO. 82 -58 ADOPTING THE OFFICIAL WHATCOM COUNTY ZONING ORDINANCE: TEXT AND MAP, TITLE 20 OF THE WHATCOM COUNTY CODE, FOR THE LAKE WHATCOM SUBAREA OF THE WHATCOM COUNTY COMPREHENSIVE PLAN WHEREAS, Ordinance No. 82 -58 enacts official land use controls for the Lake Whatcom Subarea of the Whatcom County Comprehensive Plan; and WHEREAS, an intensive scientific investigation is being conducted of the impact of development on the quality of Lake Whatcom water, NOW, THEREFORE, it is ordained by the Whatcom County Council that Ordinance No. 82 -58 is amended to read as follows: 1. The official Whatcom County Zoning Ordinance text and map, designated as Title 20 of the Whatcom County Code are hereby adopted for those areas of the Lake Whatcom Subarea designated for non -urban uses that would have minimal potential of adversely affecting the quality and quantity of the watershed for those areas located outside the boundaries of the watershed. These non -urban uses constitute the areas desplayed on the zoning map as Forestry, Recreation Open Space, Rural and Rural Residential one dwelling unit per acre and any areas-located outside the watershed regardless of urban or non -urban classifications. 2. That portion of the zoning ordinance which proposes urban level uses and densities within the watershed is hereby adopted as an emergency land use control under the authority of RCW 36.70.790 and shall remain in effect until July 1, 1985.1 These urban level uses and densities constitute the areas desig- nated on the zoning map as Urban Residential Low, Urban Residentia ORDINANCE - 1. To insure that development anticipated in areas planned for urban level uses and densities occurs in an environmentally responsible manner, Whatcom County hereby requests the Whatcom County Environmental Review Committee to forward its recommendation to identification and establishment ofenvironmentally sensitive areas in the Lake Whatcom watershed area as required in Environ- mental Policy 1.11 in the Lake Whatcom Comprehensive Plan no later than September 30, 1982. 4. Upon completion of the Lake Whatcom Restoration Study the emergency zoning enacted herein shall be reconsidered by the Whatcom County Council as the basis for ,permanent land use controls. At that time a SEPA threshold determination shall be performed pursuant to SEPA guidelines (WAC 197 -10) which will evaluate the various potential impacts of the said proposed zoning upon the continued safe use of Lake Whatcom as a public drinking water supply. 5. On or before December 31, 1982, Whatcom County shall adopt design and development performance standards covering drainage, land clearing, road construction, and filling of land within the Lake Whatcom watershed. 6. All prior ordinances are hereby repealed to the extent that they are in conflict with this ordinance, adjusted-as needed by the Prosecuting Attorney's office.
