HomeMy WebLinkAboutord1984-0031 DATE: 2 3 4 i 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 December 15, 1983 INTRODUCED BY: Roehl PROPOSED BY: Council Chair at request of Committee of the Whol ORDINANCE NO. 84 -3 AN ORDINANCE AMENDING ORDINANCE NO. 82 -56, AMENDING THE 1970 WHATCOM COUNTY COMPRE- HENSIVE PLAN TEXT AND MAP FOR THE GEOGRAPHIC AREA COM1,40NLY KNOWN AS THE LAKE WHATCOM SUB- AREA OF WHATCOM COUNTY, WASHINGTON WHEREAS) Ordinance No. 82 -56 adopts a comprehensive land use II Plan for the Lake Whatcom Subarea; and WHEREAS, an intensive scientific investigation is being 11 conducted of the impact of development on the quality of Lake Whatcom water, NOW, THEREFORE, it is ordained by the Whatcom County Council that Ordinance No. 82 -56 is amended to read as follows: 1. The 1970 Whatcom County Comprehensive Plan text for the geographic area commonly known as the Lake Whatcom Subarea of Whatcom County is hereby amended as indicated in Exhibit "A ", which is attached hereto and incorporated by reference herein. Provided, however, that this adoption shall apply exclusively for those areas of the Lake Whatcom Suabarea designated for non- urban uses that would have a minimal potential of adversely affecting the quality and quantity of the watershed. These uses constitute the areas designated in the Plan as Forestry, Recrea- tion Open Space, Rural and Rural Residential one dwelling unit per acre. 2. That portion of the Lake Whatcom Plan which proposes urban level uses and densities located within the watershed is hereby adopted upon an interim basis and shall remain in effect until ' July 1, 1985. These urban uses and densities consti- tute the areas designated on the comprehensive plan as Urban Reserve Low Density, Urban Reserve Medium Density, Quasi - Public (zoned Urban Residential), Resort Commercial and Rural Residential ORDINANCE - 1. Upon completion of the Lake Whatcom Restoration Study the 3 interim plan enacted herein shall be reconsidered by the Whatcom 4 County Council as the basis for permanent land use controls. At 5 that time a SEPA threshhold determination shall be performed 6 pursuant to SEPA guidelines (WAC 197 -10) which will evaluate the 7 various potential impacts of the said proposed comprehensive plan 8 upon the continued safe use of Lake Whatcom as a public drinking 9 water supply. 10 4. The Comprehensive Plan Map for the Lake Whatcom Subarea is 11 hereby amended to indicate the new text changes, comprehensive plan 12 classifications and boundaries thereof. The Comprehensive Plan 13 Map for the Subarea is incorporated with Exhibit "A ". The Chair - 14 person of the Whatcom County Council shall affix his signature to 15 the Text document and Map indicating Council approv8J. 16 5. This ordinance shall not take effect until the zoning text 17 and zoning map for the Lake Whatcom Subarea area are approved by 18 th4 County Council. 19 6. November 14, 1983 f 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 that have been executed between the City of Bellingham and Water and Sewer District No. 10 prior to the adoption of the Lake Whatcom Subarea Plan, individual wells or connections to the North Shore sewer line to serve existing platted lots of record, or the areas within two or more ULID's existing at the time of the adoption of the Lake Whatcom Subarea Comprehensive Plan. This policy does also not apply to preliminary plat applica- tions that have been filed prior to the adoption of this policy and the time limits that the County Council must act on the preliminary plat as described by statute have expired.
