5 AN ORDINANCE IN THE MATTER OF THE ADOPTION OF
THE FINAL BUDGET OF WHATCOM COUNTY FOR THE
6 YEAR 1986 AND RESTRICTING THE EXPENDITURE OF
CERTAIN FUNDS THEREIN

WHEREAS, pursuant to and in conformity with the provisions of Home
8 Rule Charter, Section 6.10 relating to the County Budget system,
the Whatcom County Executive did complete and place on file a
9 Preliminary Budget for Whatcom County for the fiscal year of 1986;
and
10
WHEREAS, following the completion of the Preliminary Budget, a
11 notice was published once each week for two consecutive weeks in
the official newspaper of said County, which notice stated that
12 the County Council would meet on October 24, 1985, at 7 :00 p.m.
for the purpose of considering the Preliminary Budget presented by
13 the County Executive, and ultimately fixing the final budget and
making tax levies, and that any taxpayer might appear and be heard
14 for or against any part of said budget; and,
15 WHEREAS, several meetings of the Finance Committee were held
between the dates of October 21 and November 20, 1985, to analyze
16 the amounts set forth for each department in the Budget and to
make recommendations for changes; and,

WHEREAS, the County Council and its Finance Committee has analyzed
18 the amounts set forth in the Budget in reference to deciding
whether the amounts were proper and necessary amounts to be used
19 by the various departments of Whatcom County for the year 1986;
and,
20
WHEREAS, notice was published once each week for two consecutive
21 weeks in the official ne --na per of the County, which notice stated
that the County Council ulid meet on November 22, 1985, at
22 7 :00 p.m. for the purpose of public hearing on the Preliminary
Budget as presented by the County Executive and the recommended
23 changes from the Council Finance Committee, together with the
Committee's proposed restrictions on the expenditure of certain
24 appropriations, and said public hearing was in fact held.
25 NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council:
26 Section I. Adoption of Budget
27 The amounts hereinafter set forth in the attached Exhibit "A" and
incorporated herein by reference are hereby adopted as the Whatcom
28 County Budget for the year 1986.
29 Section II. ProvisiQns Rea J. ingxgendit res
30 Pursuant to Section 6.60 of the Whatcom County Home Rule Charter,
the following provisions restricting the expenditure of certain

I appropriations are enacted for the 1986 fiscal year. These
provisions are an integral part of the official budget of Whatcom
2 County and shall be published therewith. Appropriation authority
is given only for expenditures made in conformity with these
3 provisions and other County ordinances and legislative acts.
Expenditures inconsistent therewith are unauthorized, improper,
4 and unlawful.
5 (A) All monies appropriated herein within the Current Expense
Fund, Non - Departmental category for mental health and alcoholism
6 shall provide for the maximum amount of direct service delivery
and shall not work to increase the proportions of the recipient
7 organizations' budgets that are devoted to administrative and
overhead expenses. It is further directed that the money appro-
8 priated therein for mental health shall provide for an array of
services to serve the acutely, chronically and severely mentally
9 ill, together with the seriously disturbed and victims of child
abuse and child sexual abuse, under specifications established by
10 the Whatcom County Mental Health Administrative Board, with
special emphasis on reducing the entry of mentally ill persons
11 into the criminal justice system.
12 (B) None of the monies appropriated herein shall be used for
travel, lodging, or registration expenses for seminars, workshops,
13 conventions, association meetings, or out of County trips, except
as is required by law for mandated training or professional
14 accreditation, or as has been approved in advance by the County
Executive (for executive or administrative employees) or the
15 Chairperson of the County Council or the Finance Committee (for
legislative employees).

(C) This is an item, sub -item budget and expenditures are
17 authorized only in accordance with the budget and accounting
sub -item delineations contained in the budget ordinance and
18 addenda thereto, except as may be otherwise authorized by the
County Executive pursuant to his /her authority to make line -item
19 transfers, as set forth in Chapter 3.04 of the Whatcom County
Code. The appropriations for personnel designate specific
20 positions; funds appropriated for a specific position shall not be
transferred to other positions without the approval of the County
21 Council. The departments and agencies of Whatcom County funded
under this ordinance are not authorized to expend money on
22 personnel positions in excess of the number of positions identi-
fied within the applicable departmental or agency budget.

(D) To the extent they are available, motor pool cars shall be
24 utilized for County travel purposes by employees stationed in the
central County complex before privately -owned vehicles are used on
,5 a reimbursement basis. The County Executive shall be authorized to
grant exemption from this provision when the cost of a motor pool
26 vehicle would exceed the cost of the use of a private automobile.
27 (E) All construction work funded herein for which the estimated
cost is over $25,000 shall be bid out to private contractors,
28 pursuant to the bid procedures contained in Whatcom County Code
Chapter 3.08 and applicable state laws, except as the Council may
29 specifically authorize by exception.
30 (F) Computer, photocopying, word processing and typewriting
equipment, and other office equipment and furniture shall be
31 purchased through the Purchasing Department pursuant to a policy
and specifications designed to promote cost reductions, compati-
32 bility, standardization and interchangeability of equipment,

parts, and software, and optimum use of surplus equipment and
furniture. The policy and specifications shall be approved by the
County Executive.
(G) Expenditures from the Emergency Contingency Fund, the
Physical Plant and Facilities Capital Fund, the Juvenile Detention
Facility Reserve Fund, and the Human Services Emergency Contin-
gency Fund shall be made only upon appropriation of the Council.
(H) The Purchasing Department shall be responsible for all office
equipment maintenance and repair contracts, and with the County
Executive's approval and subject to all pertinent laws, is the
sole department authorized to negotiate and enter into such
contracts on behalf of Whatcom County. The Purchasing Department
shall take advantage of contract consolidation and competitive
bidding to promote cost savings.
(I) Any monies appropriated for senior services programs within
the Parks and Recreation Fund budget may not be transferred to any
other activity or program.
(J) No requisitions or claims shall be submitted to or processed
by the Auditor or Purchasing Agent without sufficient unobligated
expenditure authority in the object code line-item in question,
except as allowed in the transfer process. Executive approval
must precede the commitment of funds .above .line -i.tem appropria-
tions for personal services and t.ravel and any combination of
other line- -items exceeding $50000.00 in any quarter.
(K) To protect the taxpayers' investment, and to insure the
safety of the traveling public, the administration is to establish
a road maintenance program that sets as its first priority
seal- coating improved county roads and the attendant necessary
work. Funds in the following rub -base elements in the County Road
Fund maintenance budget (542.00) shall be prioritized in a manner
to accomplish this goal:
542 -32, 542 -33, 542 -38, 542 -671 542 -68, 542 -78, and 542-79.
In case of emergency, the Public Works Director, with prior
approval of the County Executive, may direct these funds for
emergency road repairs. If funds are utilized for such emergen-
cies, the administration shall make a report to the County Council.

(L) To the extent possible consistent with the official budget
adopted by this ordinance, the various departments of Whatcom
County shall deploy their resources so as to meet the maintenance
of service level requirements of federal and state grant contracts
(for example, in offices funded to handle juvenile and drinking
driver problems). The Prosecuting Attorney is requested to
prioritize the prosecuting of crifies involving violence, drunk
driving, child abuse, and child sexual abuse, and to de- prioritize
the prosecution of victimless crimes.
(M) The County Auditor shall advertise the availability of motor
vehicle licensing agencies throughout the County.
(N) The monies appropriated within the PerHonnei Department for
employee training shall be utilized to upgrade the professional
and technical skills of county employees, in order that they may
better serve the public and manage the public's resources and
programs. Special emphasis shall be given to training to increase

1 productivity and the development of work- related professional
skills. The Personnel Director shall report to the Council by
2 July 1, 1986, on the progress of employee training.
3 (0) The Executive and Budget Director are requested to develop,
in cooperation with the Finance Committee, a general budgeting and
4 financial management ordinance, and to submit a proposed ordinance
no later than July 31, 1986.

(P) Appropriation authority for any budgeted personnel position
6 which becomes vacant during 1986 shall continue unless the Council
by motion identifies the position as one in need of review. The
7 Executive shall report to the Council once each month on those
positions wherein an upcoming vacancy is anticipate4 or has
8 occurred.
9 (Q) The County Executive shall designate either the Budget
Director, Alcoholism Services Coordinator, Developmental Disa.bil-
10 ities Coordinator, or the Mental Health/Drug Abuse Coordinator as
the Whatcom County Human Services Coordinator, whose duties shall
11 be to foster better coordination and cost - effectiveness in the
delivery of human services programs by the County, and addition -
12 ally, to promote cooperative endeavors with other public and
private agencies. The Human Services Coordinator shall assess the
13 human service needs of the community and recommend how best to
target the County's limited funds that are available for human
14 services programs. Should the County Executive fail to designate
a Human Services Coordinator, then the Mental Health /Drug Abuse
15 Coordinator shall serve in that capacity.
16 (R) At least 20 beds in the Jail. shall be made available for
housing federal prisoners by means of long term contract with the
17 federal government. Appropriation authority for the two newest
correctional officers will lapse unless this policy is completely
18 implemented by March 1, 1986.
19 (S) The Public Works Department .hall, in conformance with
applicable ordinances governing personal services contracts,
2U contract for a comprehensive inventory and analysis of the
County's present and future facility and space needs. At least:
21 preliminary results of the study shall be presented to the Council
and Executive by October 1, 1986. The request for proposals or
22 bids issued for this project shall first be approved by the
Council and Executive. Expenditures for this purpose may be made
23 out of either the Physical Plant and Facilities Capital Fund or
the Real Estate Excise Tax Capital improvement Fund or both.
24 (T) The Public Works Department shall contract with Western
Washington University or other appropriate contractor for a mA..ket
25 study on the relationships between Lumm.i, Island ferry rates,
26 ridership, and revenue. The study shall also provide recommenda-
tions on a rate structure or structures that will maintain the
27 system as seventy -five percent (75t) self- supporting.
28 (U) All unexpended monies in the Expo '86 Fund shall remain in
the Fund, provided, however, that after November 1, 1986, the Fund
2� shall be re- entitled the "Human Services Emergency Contingency
Fund ".

(W) The Council intends that an equivalent of at least two
full -time deputies in the Prosecutor's office shall be devoted to
the civil functions of that office. Expenditure authority for
deputy positions is conditioned upon compliance with this provi-
sion.
(X) An additional $5,000 is provided in the Extra Help categories
for each of the following departments: District Court, Prosecu-
ting Attorney, and Public Defender. These funds are intended to
provide relief time during the first quarter of 1986 to free up
key personnel in these offices for coordinated planning sessions
to improve management and efficiency in the criminal justice
system, and are provided only on the condition that this use be
made of them..
(Y) The Superior Court judges are requested to study the issue of
payment for transcripts by court reporters and report to the
Council no later than June 30, 1986, on any potential that may
exist for reducing costs or increasing revenues to 'the County for
production of transcripts and for ensuring that public resources
are not utilized for private gain.
(Z) The County Council shill by March 1, 1986, take whatever
steps are necessary to increase the credit against fines for jail
time from $25 to $35 per day.
(AA) The County Executive in consultation with

1986 Whatcom County Budget
The Whatcom County Council, at a Special Council meeting
held on Thursday, December 12r 1985, voted on a motion to
override the County Executive's veto of the 198; budget. The
motion carried on a 5--2 roll call. vote (Muenscher, Roehl). The
1986 Whatcom County budget as originally adopted on November 25,
1985, will stand as it is presently written.
