ORDINANCE NO. 85-96
AN ORDINANCE AMENDING WHATCOM COUNTY
CODE SECTION 8.12 FOR THE PURPOSE OF REVISING
THE FEE SCHEDULE FOR SOLID WASTE DISPOSAL
AT ALL- WHATCOM COUNTY SOLID WASTE SITES
WHEREAS, Whatcom County, under Revised Code of Washington 36.58.010
has acquired certain sites for the use of the public in disposing of solid
waste; and
WHEREAS, R.C.W. 36.58.020 grants the County authority to establish
rules and regulations for such sites; and
WHEREAS, Whatcom County Code Section 8.12, as amended by Ordinance No.
83-96 84 -53, sets forth the fee schedule for solid waste disposal, and
WHEREAS, until now there has only been one charge for landfill as well
as transfer facilities, however, due to the additional hauling and handling of
the material connected with transfer facilities it has become necessary to
charge an additional fee at the transfer facilities to reflect that handling
charge.
WHEREAS, the Whatcom County Council fixed a date of hearing on the
matter of amending solid waste disposal fees, and said hearing was duly held
on Noveml.)er 7 , 1985, in the Whatcom County Council Chambers, second floo
of the Whatcom County Courthouse, and all persons present being heard and all
matters being considered by the Whatcom County Council;
NOW, THEREFORE, BE IT ORDAINED that Section 8.12 of the Whatcom County Cod
is hereby amended as follows:

The following fee schedule is adopted for disposal ofrefuse *n
solid waste at all Whatcom County landfill and transfer facility sites:

BE IT FURTHER ORDAINED that the Administration shall be authorized to
charge the increased fees set forth in this ordinance provided a minimum of
$25,000 be expended each year for the development and /or implementation of a
waste reduction and recycling programr_ provided further that the administrat4e
shall 441at 1984 but need not expend the full $26,999 4m i984.-.
BE IT FURTHER ORDAINED that this amendment shall become effective on
February 1, 1986.
