ORDINANCE NO. 85 -66
AN ORDINANCE CREATING THE SETTLEMENTS OF DIABLO
AND NEWHALEM AS OFF- LIMITS FOR FIREARMS AND
BOWS UNDER WHATCOM COUNTY CODE CHAPTER 9.32.
WHEREAS, the cities of Newhalem and Diablo border the United
States Government Park; and
WHEREAS, said Park does contain wildlife such as deer which
presently are being hunted within the communities of Diablo and
Newhalem; and
WHEREAS, there is a genuine concern for the safety of the
citizens living there as a result of people hunting game within ti
cities of Diablo and Newhalem; and
WHEREAS, the citizens of the area have asked the Council for
assistance in creating a safer environment to live in; and
WHEREAS,, the Council agrees that it would be in the public's
best interest to restrict the discharge of either firearms or bows
within the confines of Newhalem and Diablo.
NOW, THEREFORE, BE IT ORDAINED as follows:
That Whatcom County Code Chapter 9.32 be amended as follows:
Chapter 9.32
UNLAWFUL DISCHARGE OF FIREARMS AND BOW AREAS
BE IT FURTHER ORDAINED that Whatcom County Code Chapter 9.32
shall be amended by adding a new section to read as follows:
9.32.005 Definitions, A. Firearms as used in this chapter
means any weapon or device from which a projectile may be fired by
an explosive such as gunpowder.
to project arrows that possess forty (40) pounds or more of pull
measured at twenty -eight (28) inches or less of draw strength.

BE IT FURTHER ORDAINED that Whatcom County Code Chapter 9.32
shall be amended by adding a new section to read as follows:
9.32.170 In Newhalem. A. It is unlawful to discharge any
firearm or bow within the following described area: Government
Lots Six (6), Seven (7), and Ten (10); in Section Twenty -One (21),
Township Thirty -Seven (37) North, Range Twelve (12) Eafit, W.M.,
more commonly referred to as Newhalem, except within such areas as
shall be designated and posted as firearms or bow ranges by Seattle
City Light. (A description of such excepted areas shall be filed
with the Whatcom County Sheriff and County Council.l
B. Any person who violates this section shall be punished by
a fine of not less than Ten Dollars ($10.00) or more than One
Hundred Dollars ($100.00), or by imprisonment in the Whatcom County
Jail for a period not to exceed thirty (30) days, or both said fine
and imprisonment.

9.32.180 In Diablo, A. It is unlawful to discharge any
firearm or bow within the following described area:
That portion of the Gloe G. Davis Homestead
Entry No. 124 in Sections Five (5), Six (6) and
Seven (7), in Township Thirty -Seven (37) North,
Range Thirteen (13) East W.M., unsurveyed land
In Whatcom County, Washington, described as
follows;
Beginning at a corner No. 1, situated on right
bank of Skagit River, from which United States
Location Monument No. 124 bears North 36 10'
20" East 32 3/10 chains distant, thence north
forty -five degrees ten minutes west 9 and
Thirty -two hundredths chains to corner No. 2;
thence North fifty -six degrees fifteen minutes
East Twenty and twenty -eight hundredths chains
to corner No. 3, thence north eighteen degrees
forty -eight minutes east nine and five - tenths
chains to corner No. 4; thence north sixty -
eight degrees twenty minutes east twenty -four
and seventeen - hundredths chains to corner
No. 5, thence south thirly -two degrees thirty-
six minutes east fifteen and seven - hundredths

and fifty -six hundredths acres. More commonly
referred to as Diablo
except within such areas as shall be designated and posted as
firearms or bow ranges by Seattle City Light. .(A description of

B. Any person who violates this section shall be Punished by

Hundred Dollars 100.00), or by imprisonment in the Whatcom County
Jail for a period not to exceed thirty (30) days, or for both said
fine and imprisonment.
