ORDINANCE NO. 85 -65
AN ORDINANCE AMENDING WHATCOM COUNTY CODE 2.24, THE
INTERIM ZONING ORDINANCE TO ELIMINATE PLANNED UNIT
DEVELOPMENTS (P.U.D.'s) AS PERMITTED OR CONDITIONAL
USES. AND TO ELTMINATE ALL OTHER REFERENCES TO
PLANNED UNIT DEVELOPMENT AND TO PROVIDL CERTAIN
CONDITIONAL USES IN S4, RMD7, RDM and RDH ZONES.
WHEREAS, the S4, Suburban District four (4) families per
acre; RMD7, Residential Medium Density - seven (7) families per
acre; RDM, Resort District - Medium Density; and RDH, Resort
District - High Density Disl:ricts in the Interim Zoning Ordinance
were adopted for the Birch Bay Area in 1978; and,
WHEREAS, a planned unit development (PUD) Chapter of the
Interim Zoning Ordinance was anticipated when those zone
districts were adopted; and,
WHEREAS, the text of those zone districts included
references to the PUD Chapter; and,
WHEREAS, provisions for approving certain permitted and
conditional land uses as PUD's acid sections listing maximum lot
sizes and other standards for PUD's; and,
WHEREAS, a PUD Ordinance was adopted as a component of
the official Whatcom County Zoning Ordinance, Title 20; however,
said PUD Ordinance does not apply to the Birch Bay area; and,

WHEREAS, the Bureau of Buildings & Code has initiated an
amendment to the Interim Zoning Ordinance to eliminate PUD's as a
permitted or conditional use; and,
WHEREAS, the Whatcom County Planning Commission received
this amendment and held the required hearings and after such has
proposed that the Whatcom County Council adopt the requested
amendment; and,
WHEREAS, the Whatcom County Council deems it appropriate
to remove the mention of PUD's from within the Interim Zoning.
Ordinance since the PUD's as adopted and Title 20 do not apply to
that area.
NOW, THEREFORE, BE IT ORDAINED that Whatcom County Code
2.24.181 be amended as follows:

BE IT FURTHER ORDAINED that the next section of Whatcom
County Code 2.24.181.163 shall be amended to change the number of
.163 to .162 except for this change all other terms and
conditions of that section shall remain the same.
BE IT FURTHER ORDAINED that Whatcom County Code 2.24.181
shall be further amended by adding a new section which will be
titled as follows:
163 Cluster dwellinqs and townhouses.
BE IT FURTHER ORDAINED that Whatcom County Code 2.24.181
shall be further amended by adding a new section as follows:
.164 Institutional uses which are compatible with the
purpose and permitted uses of this and immediately adjacent
zones.
BE IT FURTHER ORDAINED that Whatcom County Code Section
2.24.181 shall be amended by adding a new section as follows:
.165 Convenience retail shops.
