ORDINANCE NO. 85 -40
IN THE MATTER OF AMENDING SECTION 2.24.770
OF THE WHATCOM COUNTY INTERIM ZONING
ORDINANCE PROVIDING FOR THE HEARING
EXAMINER TO MAKE FINAL DECISIONS
ON PRELIMINARY PLATS
WHEREAS, Chapter 58.17 RCW specifically provides for the expeditiou
review and approval of proposed subdivisions which conform to zonin
standards and local plans and policies; and
WHEREAS, subsequent to numerous citizen involvement meetings and
required public hearings, Title 21 (Subdivision Regulations) is
being considered to enable the Hearing Examiner to make final
decisions on preliminary plats with the provision for such de-
cisions to be appealed to the County Council; and
WHEREAS, Section 2.24.770 of the Whatcom County Interim Zoning Ord-
inance presently authorizes the Hearing Examiner to recommend
decisions on preliminary plats and needs to be revised consistent
with Title 21 to authorize the Hearing Examiner to make final de-
cisions on preliminary plats; and
WHEREAS, the County Council would remain as the sole authority to
approve final plats pursuant to Chapter 58.17.100 RCW.
NOW, THEREFORE, BE IT ORDAINED that'the Whatcom County Interim Zoni
Ordinance shall be amended by striking 2.24.770.591(1), "fretiminar
plats -of- proposed - subdivisions - including- subdivision- variances -for
subdivisions -of- fine- f5'1 -or- more - lots -" renumbering (2) and (3)
accordingly; and amending 2.24.770.592 by adding a new section (13)
The new section shall read: "Preliminary plats of proposed sub-
divisions including subdivision variances for subdivisions of five
or more lots."
