HomeMy WebLinkAboutord1985-0331 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 INTRODUCED BY Consent PROPOSED BY Council DATE May 16, 1985 ORDINANCE NO. 85 -33 AN ORDINANCE AMENDING THE INTERIM ZONING ORDINANCE, AS WELL AS THE OFFICIAL ZONING ORDINANCE WITH REGARDS TO FEES CIiARGED FOR VARIANCE, CONDITIONAL USE OR SIMULTANEOUS VARIANCE AND CONDITIONAL USE APPLICATION WITH REGARDS TO FEES CHARGED FOR APPLICATION OF NOTICES WHEREAS, presently Whatcom County has an interim zoning ordinance which is found'at 2.24.660 which contains a fee section located at .690; and WHEREAS, the Whatcom County Code has an official zoning ordinance which is found at 20.84.250 which has a fee section located at .250; and WIiEREAS, in each section the fees charged for the filing of a variance application or conditional use application or the com- bination of a variance and conditional use application is the same; and WHEREAS, after reviewing the situation it appears to be in the public's best interest that these ordinances be amended to add the cost of mailing and publishing notices of the required hearings on these types of applications being passed through to the person who is filing the application, and that some applications require the sending of notices to large numbers of property owners; and WHEREAS, presently the application fee does not take into account the number of notices or the actual costs which the County will incur, thereby having the people who only have a few notices subsidizing those people who require more notices; and WHEREAS, amending the code sections so as to provide a variable fee will be more equitable to everyone, NOW, THEREFORE BE IT ORDAINED that the interim zoning ORDINANCE - 1. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Isection 2.24.660.690 shall be amended as follows: .690 FEES .691 Each application for a Variance shall be accompanie by a fee of $100.00 plus actual costs of mailing and, when applicable, publishing notices of the hearing on the application. .692 Each application for a Conditional Use, or expansion) of a non - conforming use, shall be accompanied by a fee of $125.00 plus actual costs of mailing and, when applicable, publishing notices of the _hearing on the application. .693 Each simultaneous application for a Variance and a Conditional Use (or expansion of a non - conforming use) for the same property, shall be accompanied by a fee of $125.00 plus actual costs of mailing and, when applicable, publishing notices of the hearing on the application. BE IT FURTHER ORDAINED that unless specifically amended by this ordinance, each and every fee set under .690 shall remain in full force and effect. BE IT FURTHER ORDAINED that section 20.84.250 shall be amended as follows: .250 FEES (1) Each application for a variance shall be accomplish by a fee of one hundred dollars ($100.00) plus actual costs of mailing and when applicable, �qlisbing notices of the hearing on the applicatioi (2) Each application for a conditional use, or expans of a nonconforming use, shall be accompanied by a fee of one hundred twenty -five dollars ($125.00) plus actual costs of mailing and. when applicable i (3) Each simultaneous application for a variance and a conditional use (or expansion of a nonconforming use) for the same property shall be accompanied by a fee of one hundred twenty -five dollars ($125.00) plus actual costs of mailing and, %hen applicable, publishing notices of the hearing on the aDDlicatio . BE IT FURTHER ORDAINED that unless specifically mentioned within this ordinance, each of the following fees and conditions set out in .250 shall remain in full force and effect.
