AN ORDINANCE AMENDING TITLE 20.40 OF THE
6 INTERIM ZONING ORDINANCE
7 WHEREAS, presently the Interim Zoning Ordinance does not
8 provide the opportunity for a small scale restaurant to be
9 located in the agricultural zone; and
10 WHEREAS a proposal has come forth which indicates this type
11 of activity would be beneficial; and
12 WHEREAS, the Planning Commission held a public hearing and
13 then acted on this amendment; and
14 WHEREAS the amendment failed in that it did not receive a
15 majority vote, failing by a 4 -2 vote in favor of the amendment;
16 and
17 WHEREAS after a review by the Council such an amendment is
18 in the best interests of the health, safety and welfare of the
19 general public,
20 NOW, THEREFORE, BE IT ORDAINED that Section 20.40 of the
21 Interim Zoning Ordinance shall be amended by adding a new section
22 as follows:
23 .164 Restaurants, when located on the same property
and subordinate to a permanent facility, for the
24 processing of agricultural products into food
or beverage for human consumption, provided
25 that the size, scale and character of the
restaurant facility are compatible with the
26 agricultural /rural character of the surrounding
area and are consistent with the general
27 purpose of the zone district.
