INTRODUCED BY: Consent PROPOSED BY: Council DATE: May 2. 1985 ORDINANCE NO. 85 -31 AN ORDINANCE AMENDING THE SETBACK REQUIREMENTS OF THE GENERAL MANU- FACTURING ZONE FOUND IN WHATCOM COUNTY CODE 20.80. WHEREAS, the Planning Department has initiated an amendment to the side and rear yard setbacks to the General Manufacturing District of Title 20; and WHEREAS, this amendment would affect the General Manufacturing District located at East Bakerview and Hannegan Roads' intersection; and WHEREAS, legal notice was published concerning this amendment; and WHEREAS, a determination of nonsignificance was issued by the Deputy SEPA Official; and WHEREAS, the amendment would only affect adjacent properties within the General Manufacturing Zone and not properties within nonindustrial districts located adjacent to the General Manufacturing District; and WHEREAS, the amendment would only affect the location of structures and not increase the amount, intensity or type of industrial activity; and WHEREAS, the amendment is intended to address an. inconsistency between the LII and GM District regulations while still recognizing the general differences of the two districts; and WHEREAS, the amendment would allow greater flexibility in building location and, consequently, provide greater options for industrial development which is a benefit to the general public health, safety and welfare; NOW, THEREFORE, BE IT ORDAINED,, that Whatcom County Code 20.80.210 be amended as follows: -1- A 20.80.210 MINIMUM BUILDING SETBACKS (Amended per W.C.C. 20.04.080(1)(a),(h)) * Roof overhangs or other architectural features shall not project further than 18-inches into the side or rear yards. + Refer to the additional provisions of WCC 20.80.250, 20.80.260, 20.80.2 70 and 20.80.280. o Or as modified pursuant to Section 20.80.286(2) -2- Appl. to Local Minor Add. (2) General Manufacturing District: The Zoning Administrator may reduce side and rear yard setbacks if all of the following provisions are met: (a) Screening shall be provided to protect adjacent uses from unsightliness or visual distraction; (b) All structures and improvements including roof overhangs do not cross property boundariesc and runoff shall be diverted to onsite drainage facilities; (c) The reduced setbacks would not reduce solar access on adjacent properties unless all parties having an ownership interest in the property adjacent to the side or rear yards to be reduced stipulate in writing, on forms provided by the Zoning Administrator, to the reductions. The Zoning Administrator may require a title report to establish the owner- ship interests in the adjacent proper; (d) Light sources would be shielded; (e) The use and storage of toxic or hazardous materials or processes shall not be located -3- ."4 1 2 3 4 5 6 7 8 9 10 11 12 1 13 14 within the setback unless adequate facilities to contain accidental spills onsite consistent with state regulations are provided; and (f) The reduced setbacks would not interfere with existing sewer, water and other easements. IT IS HEREBY FURTHER ORDAINED, that unless specifically mentioned in this Ordinance, all other Sections of Whatcom County Code Chapter 20.80 shall remain in full force and effect.
