INTRODUCED BY Consent PROPOSED BY Public Works DATE April 18, 1985 F AN ORDINANCE RELATING TO PROHIBITING LEADING, RIDING, OR PLACING OF HORSES ON BIRCH BAY DRIVE BETWEEN PT. WHITEHORN ROAD AND SHINTAFFER ROAD IN THE UNINCORPORATED AREA OF WHATCOM COUNTY BETWEEN MAY 1ST AND SEPTEMBER 30TH, PROVIDING REGULATION, ENFORCEMENT AND PENALTIES, AND DESIGNATING THE WHATCOM COUNTY SHERIFF AS THE RESPONSIBLE AUTHORIZED AGENT FOR REGULATION AND ENFORCEMENT. WHEREAS, the Whatcom County Council has determined the public health, safety and general welfare requires prohibiting the riding, leading or use of horses on traffic- congested county roads, NOW, THEREFORE, THE WHATCOM COUNTY COUNCIL DOES ORDAIN: Section 1. Unlawful Practices. That it shall be unlawful for any firm, person, company or corporation to ride, lead, or use any horse or horses within the County right -of -way on Birch Bay Drive between Pt. Whitehorn Road and Shintaffer Road between May 1st and September 30th of each year, except police officers or park patrol officers in the performance of their duties. Section 2. Parades Excluded. This ordinance does not apply to the use of horses in formal parades, which are conducted under valid permit or license. Section 3. Violations and Penalties. Violations of any of the provisions of this ordinance shall constitute a misdemeanor and upon conviction shall be punishable by fine not to exceed $100.00. Section 4. Severabil:ity. If any provision of this ordinance or its application to any person or circumstance is held invalid, the remainder of this ordinance, or application of the provisions to other persons or Ordinance - 1, Substitute Draft 2, 4/30/85 1 circumstances is not affected. 2 Section 5.
