ORDINANCE NO. 85 -28
AN ORDINANCE AMENDING THE EROTIC DANCE
STUDIO ORDINANCE NO. 85 -11 TO INCREASE THE
LICENSE CHARGE
WHEREAS, on the 22nd day of February, 1985, the Whatcom
County Council adopted the Ordinance regarding erotic . dance
studios; and,
WHEREAS, the Ordinance called for a fee of $125.00 to the
Sheriff's Department to cover the costs of filing plus a
background check on the person or persons who owned a portion of
the business or had an interest in the business; and,
WHEREAS, the information requires the Sheriff to run a
background check on anyone who has an interest in the business;
and,
WHEREAS, the fee as presently set up would not be
sufficient to cover the cost for the background investigation if
there are more than three (3) people with an interest in the
business; and,
WHEREAS, it is necessary to amend Ordinance No. 85 -11 in
order to allow the additional fee so that the Sheriff may recoup
the costs for the background investigation for each person in
excess of three (3) so that the Ordinance itself does not create a
burden to the County; and,
WHEREAS, the Whatcom County Council deems it appropriate
to readjust the fee as established in the previous Ordinance;

NOW, THEREFORE, BE IT ORDAINED THAT Ordinance No.
85 -11 Section 4 (C) shall be amended as follows:
Applications shall be accompanied by a
non - refundable fee of Five Hundred Dollars
($500.00) where there are three (3) or
less people who have an interest in the
business. There shall be an additional
charge of Fifty Dollars ($50.00) for each
person above three 3) in order to cover
the investigation costs of the Whatcom
County Sheriff's Department. Within five
5 days of receipt of an application for
an erotic dance studio license, the Sheriff
shall transmit a copy of such application
to the Bureau of Buildings and Code Admin-
istration and to the Hearing Examiner.
BE IT FURTHER ORDAINED that unless specifically
amended by this Ordinance all other provisions of Ordinance
No. 85 -11 shall remain in full force and effect.
