5 ORDINANCE NO. 85- 25
6 AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO. 84 -100
IN THE MATTER OF THE ADOPTION OF THE FINAL BUDGET
7 OF WHATCOM COUNTY MAR THE YEAR 1985 AND RESTRICTING
THE EXPENDITURE OF CERTAIN FUNDS THEREIN

9 WHEREAS, on November 28, 1984, the Whatcom County Council
10 approved the final budget ordinance for 1985; and,
11 WHEREAS, Section II(T) indicates that no personnel posi-
12 tions that become vacant within the County Road Fund for Road
13 Maintenance and Operations shall be refilled until the full
14 time equivalence employees drops below sixty -two (62); and,
15 WHEREAS, the Council had interpreted that this applied
16 to line maintenance people; and,
17 WHEREAS, it is now apparent that there are also some
18 administrative people contained in that Road Fund; and,
19 WHEREAS, a vacancy has occurred in which the public
20 peace and health of the citizens of Whatcom County needs to have
21 that position refilled as the position coordinates the operation
22 of a large portion of the fund; and,
23 WHEREAS, in order to fill this position, an amendment to
24 the final budget ordinance needs to be made; and,
25 WHEREAS, filling this vacancy is necessary for the
26 immediate preservation of the public peace, health and safety as
27 well as the continued support for County government and such an
28 emergency does presently exist, creating the need for this
29 ordinance;
30 NOW, THEREFORE, BE IT ORDAINED by the Whatcom County
31 Council that a new section shall be added to Section II of
32 1 Ordinance No. 84 -100 which shall read as follows:

(Z) The Council may, by motion, waive the
applicability of Proviso Section II(T)
in the 1985 budget which restricts the
expenditure of certain appropriations
in specific circumstances.
AND BE IT FURTHER ORDAINED that an emergency does exist
and that this section shall become effective immediately upon
passage and approval by the Executive; and, further, the Whatcom
County Council finds that the ordinance is necessary for the
immediate preservation of the public peace, health, safety and /or
support of the County government.
This ordinance shall automatically expire sixty -one (61)
days following the effective date as per Whatcom County Charter
2.40.
