HomeMy WebLinkAboutord1985-0211 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 INTRODUCED BY: Consent PROPOSED BY: Planning DATE INTRODUCED: March 24 1985 ORDINANCE NO. 85 -21 AN ORDINANCE AMENDING SECTION VI.A.1.05.2 OF THE LAKE WHATCOM SUBAREA COMPREHENSIVE PLAN FOR THE PURPOSE OF INCLUDING TRACT Y OF SUDDEN VALLEY INTO THE LANGUAGE OF THAT SECTION, AND INCLUDING NEW LANGUAGE THAT WAS INADVERTENTLY DELETED UPON PUBLICATION. WHEREAS, the Whatcom County Council approved in September of 1982, the Lake Whatcom Subarea Comprehensive Plan; and WHEREAS, Section VI A.1.05.2 of the Policies for Urban Reserve in the plan specifies that certain Tracts within the Sudden Valley analysis area shall be identified on the Official Zoning Map of Whatcom County in a manner consistent with the provisions set forth in that section; and WHEREAS, it was the intent of the Whatcom County Council that the Lettered Tract known as "Y" would be treated in the same manner and included in with the language of this section which addresses the Lettered Tracts known as Tract Z and Tract W; and WHEREAS, the Lake Whatcom Subarea Comprehensive Plan was the subject of several public hearings and the Sudden Valley Lettered Tracts, including Y, were discussed during the course of these hearings; and WHEREAS, reference to Tract Y in this paragraph was inadvertently omitted; and further that upon preparation of the final draft of the Subarea Plan part of a Sentence in the second paragraph of the above noted section was also inadvertently omitted; and WHEREAS, it is the desire of the Council to correct these oversights by amendment to the Lake Whatcom Subarea Plan; and ORDINANCE - 1. DRAFT I - 2/20/95 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 WHEREAS, the amendment would accomplish the previously expressed intent of the Council and correct both oversights and would therefore be administrative in nature. NOW, THEREFORE, BE IT ORDAINED by the Whatcom County (Council that: Section 1, the second paragraph in Section VI.A.1.05.2 of the Lake Whatcom Subarea Plan be amended as follows: "Whatcom County shall amend its zoning map to designate tracts of R, L, J, K, S, U, Q, N -2 and P (described in the "Protective Covenants for Sudden Valley Condo- minium Tracts" dated June 9, 1977 and recorded under Whatcom County Auditor's File No. 1254476) as multi- family or condominium tracts within the Medium Density (MUR -12) zoning district with maximum densities of eight dwelling units per acre. Densities may, however, increase beyond eight dwelling units per acre to ten dwelling units per acre with a commensurate reduction in single family lots located elsewhere in the Sudden Valley Subdivision or through a reduction of multi- family units allocated to the above described tracts including Tract Y." Section 2, the third paragraph in Section VI.A.1.05.2 of the Lake Whatcom Subarea Plan be amended as follows: "Whatcom County shall amend its zoning map to designate Tract Z, W, Y, the Byron Tracts and Airport: as multiple - family or condominium tracts within the Medium Density (MUR -12) zoning district with maximum densities of three dwelling units per acre. Densities may, however, be increased beyond three dwelling units per acre to ten dwelling units per acre with a commensurate reduction in single family lots located ORDINANCE - 2.
