ORDINANCE NO. 85 -10
AN ORDINANCE of the County Council of Whatcom County
confirming the final assessment roll for County
Road Improvement District No. 6 and certifying the
same to the Whatcom County Treasurer for collection.
WHEREAS, pursuant to Resolution No. 85- 4 of the County
Council of Whatcom County (the "Council "), adopted on January 17 ,
1985, a public hearing on confirmation of the final assessment
roll for Whatcom County Road Improvement District No. 6 ( "RID 6 ")
was held on February 21 , 1985 at 7:30 p.m.; and
WHEREAS, notice of the public hearing on confirmation of the
final assessment roll was duly published, and mailed to each
owner of property within RID 6 pursuant to the requirements of
RCW 36.88.090; and
WHEREAS, the Council, sitting as a board of equalization for
such purpose, gave due consideration to the final assessment roll
for RID 6 and all timely written objections filed with respect
thereto; and
WHEREAS, it is deemed necessary and advisable that the final
assessment roll for RID 6 be approved and confirmed;
NOW, THEREFORE, BE IT ORDAINED, by the County Council of
Whatcom County, Washington, as follows:
SECTION 1. The Council, sitting as a board of equalization
and having made all revisions to the roll it deems necessary,
hereby .finds and determines that the final assessment roll for
RID 6 is just and equitable, and that no' assessment against
property within RID 6 is greater than the special benefits to
be derived from the improvements. Accordingly, the final assess-
ment roll, in the total amount of 3742.00 , is hereby
approved and confirmed, and the assessments set forth therein
are hereby levied against each lot, tract and parcel of property

Section 2. The Clerk of the Council is hereby directed to
11place in the hands of the Whatcom County Treasurer for collection
Ilthe final assessment roll for RID 6, bearing such revisions as
the Council has made thereto. Upon such placement, the amount
of each assessment set forth therein, together with any interest
accrued or penalty imposed from time to time thereon, shall
become a lien against the property so assessed. Said lien
shall be paramount and superior to any other lien or encumbrance
whatsoever, theretofore or thereafter created, except a lien
for general taxes.
Section 3. Upon receipt of the final assessment roll for
RID 6, the Whatcom County Treasurer is hereby directed to publish
notice at the times and in the manner required by RCW 36.88.270,
(stating that said roll is in his hands for collection and that
such assessments or any portion thereof may be paid at any time
within thirty (30) days from the date of the first publication
of said notice, without penalty, interest or costs.
Section 4. The amount of any assessment, or any portion
thereof, against property in RID 6 not paid within the thirty
day period from the date of the first publication of the County
Treasurer's notice shall be payable in ten (10) equal annual
installments, together with interest on the diminishing principal
balance thereof at a rate to be determined by the Council.
Interest shall commence on the thirtieth day following first
publication of such notice. The first installment shall become
due and payable one year from the expiration of the thirty day
prepayment period. Annual installments, including interest and
any penalty, shall be paid in full when due, and no partial
payments shall be accepted by the County Treasurer.
Section 5. Any installment not paid when due shall thereupon
become delinquent. All delinquent installments shall be subject

1 to a penalty equal to ten percent (10 %) per annum of the amount
2 of the installment, including interest, from the date of the
3 delinquency until paid.
4 Section 6. The lien of any assessment may be discharged
5 at any time after the thirty day prepayment period herein
6 provided for by payment of the entire principal amount of the
7 assessment remaining unpaid together with interest thereon to
8 the due date of the next installment.
9 PASSED AND APPROVED by the County Council of Whatcom
