ORDINANCE NO. 86 -94
AN ORDINANCE AMENDING THE OFFICIAL WHATCOM COUNTY ZONING
ORDINANCE MAP FOR A 4.16 ACRE PARCEL IN THE URBAN FRINGE
SUBAREA FROM LIGHT IMPACT INDUSTRIAL TO GENERAL COMMERCIAL.
WHEREAS, the Planning Department has received an application from the
owners requesting that the Official Whatcom County Zoning Map be amended from
Light Impact Industrial to General Commercial for a 4.16 acre parcel located
northwest of the interchange of Northwest Road and Interstate 5 in the Urban
Fringe Subarea; and
WHEREAS, pursuant to RCW 36.70.590 legal notice of public hearing before
the Planning Commission was published in the Bellingham Herald; and
WHEREAS, the Deputy SEPA Administrator issued a Declaration of
Nonsignificance based upon the non - project nature of the application; and
WHEREAS, the Planning Commission has conducted a public hearing upon the
application and formulated Findings of Fact and Reasons for Action and a Motion
recommending approval of the application with the condition that the applicant
enter into a legal agreement to appropriately mitigate any adverse transportaion
impacts before the zoning amendment is effective; and
WHEREAS, this condition is consistent with the amendment criteria when
considering a rezone in the Urban Fringe Subarea;
NOW, THEREFORE, BE IT ORDAINED THAT:
The Title 20 Zoning Map of the Whatcom County Code shall be amended from
the zone district Light Impact Industrial to General Commercial for the 4.16
acre parcel with the legal description contained in Exhibit 1, and that this
amendment shall take effect at the time that a legal agreement to not protest as
described in Exhibit 2 shall be filed in the County Auditor's Office.

BE IT FURTHER ORDAINED THAT:
Unless specifically amended by this ordinance, all other terms and
provisions of the Whatcom County Code, Title 20, shall remain in full force and
effect.

AGREEMENT TO NOT PROTEST INCLUSION WITHIN
LOCAL IMPROVEMENT OR ROAD IMPROVEMENT DISTRICTS
The undersigned agrees not to protest inclusion of the
property, described in Exhibit "1" attached hereto within a Local
Improvement or Road Improvement District which may be formed in
the future, by Whatcom County, for the purpose of constructing
road or street improvements in the vicinity of the described
property, so long as the method determining the sharing of costs
is related to impacts caused by development.
