WHEREAS, the Planning Department has received an application from the owners requesting that the Urban Fringe Subarea Comprehensive Plan Map be amended from Light Industrial Park to General Commercial for a 4.16 acre parcel to the northwest of the interchange of Northwest Road and Interstate 5; and WHEREAS, pursuant to RCW 36.70.590 legal notice of public hearing before the Planning Commission was published in the Bellingham Herald; and WHEREAS, the Deputy SEPA Administrator issued a Declaration of Nonsignificance based upon the non - project nature of the application; and WHEREAS, the Planning Commission has conducted a public hearing upon the application and formulated Findings of Fact and Reasons for Action and a Motion recommending approval of the application with the condition that the applicant enter into a legal agreement to appropriately mitigate any adverse transportaion impacts before the comprehensive plan amendment is effective; and WHEREAS, the condition is consistent with the amendment criteria when considering a rezone for the Urban Fringe Subarea; NOW, THEREFORE, BE IT ORDAINED THAT: The Urban Fringe Subarea Comprehensive Plan Map shall be amended from the planned designation of Light Impact Industrial to General Commercial for the 4.16 acre parcel with the legal description contained in Exhibit 1, and that this amendment shall take effect at the time that a legal agreement to not protest as described in Exhibit 2 shall be filed in the County Auditor's Office.
