HomeMy WebLinkAboutord1986-068I 2 3 4 5 6 i 71 i 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 INTRODUCED BY: Consent PROPOSED BY: DATE: August 7, 1986 ORDINANCE NO. 86 -68 AN ORDINANCE EXTENDING THE TERMS OF THE NOXIOUS WEED CONTROL BOARD AND EXTENDING ITS DUTIES WHEREAS, in 1981 Whatcom County established the Noxious Weed Control Board; and, WHEREAS, Whatcom County Code 2.27.130 calls for the Board to terminate in five (5) years unless specifically reauthorized by the Whatcom County Council; and, WHEREAS, the Whatcom County Council feels that the Board performs an important function and needs to be reauthorized for an additional five (5) years; and, WHEREAS, the initial activities included education concerning all types of control of tansy ragwort and it now appears that in addition to this education, education on the knapweed is also warranted; and, WHEREAS, the Noxious Weed Control Board is the proper agency to conduct this type of education. NOW, THEREFORE, BE IT ORDAINED that Whatcom County Code 2.27 shall be amended as follows: 2.27.060 Initial activities. The initial activities of the board shall be directed to educating the public concerning all types of tansy ragwort and knapweed. BE IT FURTHER ORDAINED that Section 2.27.070 shall be amended as follows: 2.27.070 Policing activities. The board's policing activity shall be limited to control of tansy ragwort and knapweed. AND BE IT FURTHER ORDAINED that Whatcom County 2.27.130 shall be amended as follows: 2.27.130 Termination of board. The Whatcom County Noxious Weed Control Board shall terminate i�r- €tee- ear- frerfit t-13e --date - ef- -t4fe- -f- rs -t-- ifteet-irng on December 31, 1991 unless specifically reauthorized by the County Council prior thereto. - Ordinance - 1. x i h i 1 BE IT FURTHER ORDAINED that section 2.27.150 shall be 2 amended as follows: 3 2.27.150 Notice property owners'- Action by county. 4 A. Whenever the Weed Control Board finds that tansy ragword or 5 knapweed is present on any parcel of land, and that the owner 6 thereof is not taking prompt and sufficient action to abate and control the same, pursuant to the provisions of RCW 17.10.140 7 and 17.10.150, it shall notify such owner that a violation of 8 RCW Chapter 17.10 exists. Such notice shall be in writing and order prompt control action, and specify the time, of at least ten days from issuance of the notice, within which the 10 prescribed action must be taken. 11 BE IT FURTHER ORDAINED as follows: 12 13 Unless specifically mentioned herein all other terms and 14 conditions of Whatcom County Code 2.27.150 shall remain in full force and effect. 15 16 BE IT FURTHER ORDAINED that Whatcom County Code section 27 2.27.1.60 shall amended as follows: 18 2.27.160 Hearing on costs. A. Any owner, upon request 19 made within thirty days of the date of mailing of the notice 20 required under section 2.27.150 (A), shall be entitled to a hearing before the Weed Control Board on any charge or cost for 21 which the owner is alleged to be liable. The board shall send 22 notice by certified mail, to each owner residing within the 23 county at its last known address, as to any such charge or cost and as to his right of a hearing. If the owner does not reside 24 within the county, such notice shall be sent by certified mail. 25 26 B. The weed board shall schedule a public hearing within thirty days of its receipt of a valid request for 27 hearing. At such hearing the board shall receive evidence and 28 take testimony on the following issues: 29 1.
