HomeMy WebLinkAboutord1986-039} DATE: May 15, 1986 INTRODUCED BY: Consent PROPOSED BY: PLANNING 1 ORDINANCE N0. 86 -39 2 AN ORDINANCE AMENDING THE URBAN FRINGE SUBAREA COMPRE- 3 HENSIVE PLAN MAP AND TEXT FOR A PORTION OF THE SOUTHEAST QUADRANT OF THE INTERSECTION OF SMITH ROAD AND THE GUIDE 4 MERIDIAN, BOTH SITUATED IN WHATCOM COUNTY. 5 WHEREAS, the Whatcom County Planning Agency is charged with updating 6 and revising the Urban Fringe Subarea Comprehensive Plan Text and Map and 7 providing recommendations for legislative action to Whatcom County Council; 8 and 9 WHEREAS, Neighborhood Commercial Policy 1.01.3 of the Urban Fringe 10 Subarea Comprehensive Plan stated that update process of the Lynden- Nooksack 11 Valley Subarea should address application of the Neighborhood Commercial 12 plan designation to a portion of the area south of Smith Road in proximity 13 to the Guide Meridian; and 14 WHEREAS, the Whatcom County Planning Agency developed a comprehensive 15 citizen participation process that resulted in the formation of the proposed 16 comprehensive plan map and text amendment for the Urban Fringe Subarea; and 17 WHEREAS, the Whatcom County Planning Commission conducted one public 18 hearing n January 21 1986 for the g y purpose of receiving public testimony 19 on the proposed amendments; and 20 WHEREAS, the Whatcom County Planning Commission has prepared Findings, 21 Reasons, and Motion recommending adoption" of the proposed Urban Fringe 22 Subarea Comprehensive Plan and map amendments; and 23 WHEREAS, the Whatcom County Council has reviewed the Planning Agency's 24 Findings, Reasons and Motion; 25 NOW, THEREFORE, BE IT ORDAINED by Whatcom County Council as follows: 26 Section 1. In recognition of the disbursed population and limited commercial services in the central portion of the county, the intersection of the Guide Meridian and Smith Road should be planned for a future GENERAL COMMERCIAL center. To avoid linear strip development along both arterials, while providing for safe and efficient vehicular movement, future commercial development should occur in a clustered or concentrated form centered around the intersection. Section 2. Comprehensive Plan Map The Urban Fringe Subarea Comprehensive Plan Map is hereby amended for a portion of the southeast quadrant of the intersection of Smith Road and the Guide Meridian, as set forth in Exhibit 3a, which is attached hereto and incorporated herein by reference. Section 3. Validity Adjudication or invalidity of any of the sections, clauses, or provi- sions of this Ordinance shall not affect or impair the validity of the Ordinance as a whole or any part thereof, other than the part so declared to be invalid.
