ORDINANCE NO. 86 -38
AN ORDINANCE EXTENDING THE INTERIM ZONING ORDINANCE,
CHAPTER 2.24 OF THE WHATCOM COUNTY CODE,
UNTIL JULY 15, 1988
WHEREAS, pursuant to RCW 36.70.790, Whatcom County has adopted an
Interim Zoning Ordinance; and
WHEREAS, the County has established permanent zoning in certain
geographic subareas of the County, and is in the process of establishing
permanent zoning for the remaining subareas; and
WHEREAS, since extending the Interim Zoning Ordinance in 1984, the
County Planning Agency, in good faith, has conducted studies and has
held hearings for the purpose of providing recommendations to the County
Council regarding adoption of permanent zoning in the Chuckanut -Lake Samish
Subarea, the Lummi Island Subarea, and the Lynden - Nooksack Valley Subarea;
and
WHEREAS, the County Planning Agency is conducting studies and is
holding hearings for the purpose of providing recommendations to the
County Council regarding adoption of permanent zoning in the Birch
Bay - Blaine Subarea, and the remaining subareas; and
WHEREAS, the Interim Zoning Ordinance, Chapter 2.24 of the Whatcom
County Code, is scheduled to expire on July 15, 1986; and
WHEREAS, the Interim Zoning Ordinance will expire prior to the imple-
mentation of permanent zoning in all subareas of the County leaving those
subareas without zoning of any kind; and
WHEREAS, to protect the public safety, health, and general welfare, the
Interim Zoning Ordinance should be extended as an emergency measure;
NOW, THEREFORE, BE IT ORDAINED that, pursuant to RCW 36.70.790, the
Interim Zoning Ordinance, Chapter 2.24 of the Whatcom County Code, is hereby
extended until ,Title 1� 1q89

WHATCOM COUNTY PLANNING AGENCY REPORT
IN THE MATTER OF AMENDING THE 1970 WHATCOM COUNTY
COMPREHENSIVE PLAN TEXT AND MAP, AND REPEALING
THE INTERIM ZONING ORDINANCE CHAPTER 2.24 AND
APPLYING TITLE 20, THE OFFICIAL WHATCOM COUNTY
ZONING ORDINANCE AND MAP, FOR THE GEOGRAPHIC AREA
DESIGNATED AS THE LYNDEN - NOOKSACK VALLEY SUBAREA
OF WHATCOM COUNTY, WASHINGTON; AND AMENDING THE
URBAN FRINGE SUBAREA COMPREHENSIVE PLAN MAP AND
THE TITLE 20 ZONING MAP FOR AN AREA SITUATED IN
THE SOUTHEAST QUADRANT OF THE INTERSECTION OF THE
GUIDE MERIDIAN AND SMITH ROAD
FINDINGS,
REASONS,
AND
MOTION
WHEREAS, in 1979, the Whatcom County Planning Commission and Board of County
Commissioners adopted the Whatcom County -Planning Process, and in 1979, the
Planning Commission and County Council adopted the Comprehensive Plan Goal
Statements, together providing guidelines for the general direction of planning
in the county during the incremental and consistent revision of the 1970 Compre-
hensive Land Use Plan; and
WHEREAS, in 1983, the Whatcom County Planning Agency developed The Lynden -Nook-
sack Valley Subarea Background Document which presents an inventory and analysis
of environmental features, community facilities and utilities, land use, and
related issues; and
WHEREAS, the "Preliminary Lynden - Nooksack Valley Subarea Comprehensive Plan" and
attendant zoning have been developed from input received in 1984 and 1985, at ten
meetings with the Agricultural Advisory Committee; at three meeting with the
Forestry Advisory Committee; at six meetings with the mayors, planning commis-
sions or city councils of Lynden, Everson, Nooksack and Sumas; and at eight
meetings with subarea citizens; and
WHEREAS, between October and December, 1985, the "Preliminary Lynden - Nooksack
Valley Subarea Comprehensive Plan" was developed pursuant to RCW 36.70.330 and
RCW 36.70.350, and contains the required elements of land use, circulation and
groundwater, and maps; and the optional elements of community facilities and
utilities, physical constraints, natural resources, and economics; and
WHEREAS, pursuant to RCW 36.70.550, the zoning districts of The Official Whatcom
County Zoning Ordinance: Title 20 and map implement the "Preliminary
Lynden- Nooksack Valley Subarea Comprehensive Plan" and map, and said zoning
ordinance generally implements the adopted Goal Statements goal and objectives of
the comprehensive plan; and
WHEREAS, the zone districts and map provide specific regulations and exact
boundaries consistent with RCW 36.70.560; and
WHEREAS, the Whatcom County Planning Agency legally advertised on January 8,
1986, in the Westside Record Journal for a public hearing on the Comprehensive
Plan and zoning, consistent with the provisions of RCW 36.70.390 and RCW
36.70.590; and

WHEREAS, an Environmental Checklist was prepared for the "Preliminary Lynden --
Nooksack Subarea Comprehensive Plan" and attendant zoning, and a Determination
of Non - significance was issued on January 14, 1986; and
WHEREAS, a public hearing was conducted on January 21, 1986, for the purpose
of receiving public testimony on the "Preliminary Lynden - Nooksack Valley Subarea
Comprehensive Plan" and attendant zoning, pursuant to the provisions of RCW
36.70.380 and RCW 36.70.580; and
WHEREAS, the Whatcom County Planning Department prepared a staff report wherein
findings were presented to the Planning Commission that provided the basis for
the planning staff's recommendation of adoption of said plan and zoning ordi-
nance, dated January, 1986; and
WHEREAS, the Whatcom County Planning Commission conducted a series of six work
sessions on February 11, February 25, March 11, March 18, March 25, and April
15, 1986, to evaluate the public hearing testimony received at the public
hearing and revised certain portions of the plan and zoning.
NOW, THEREFORE, BE IT RESOLVED:
1. That the Planning Commission hereby adopts the findings, reasons for
action, and recommendations as presented in Exhibit 1, the "Whatcom County
Planning Department Staff Report to Amend the Whatcom County Comprehensive
Plan for the Lynden- Nooksack Valley Subarea and to Implement Said Plan by
Applying the Official Whatcom County Zoning Ordinance ".
2. The Chairman and Secretary of the Planning Commission are hereby directed
to place their signatures upon the Lynden - Nooksack Valley Subarea Comprehen-
sive Plan and zoning, and to transmit same to the Whatcom County Council
pursuant to RCW 36.70.420 and RCW 36.70.610.
