AN ORDINANCE AMENDING THE EROTIC DANCE STUDIO
ORDINANCE NO. 85 -11
WHEREAS, when the ordinance regarding the regulation of
erotic dance studios was enacted several changes were made;
and
WHEREAS, when these changes were made several deletions
were made, yet remain referenced in the ordinance; and
WHEREAS, this ordinance needs amending to clear up these
references,
NOW, THEREFORE, BE IT ORDAINED that Section 7 of ordinance
85 -11 shall be amended as follows:
GT B� Applications shall be accompanied by a non -
efundable fee of FIFTY DOLLARS ($50.00).
B,- C Within twenty (20) days of receipt of the copy
f such license /application, the Sheriff shall begin an investi-
ation to determine whether the information contained in the
16 pplication is true and accurate; the Sheriff shall conduct a
17 [criminal riminal records check to determine if the applicant has a prior
18 conviction or convictions. If no criminal record is
1911found, then the Sheriff shall issue the license. Said license
20 shall be good for one year from the date of issuance.

22IlHearing Examiner. The Sheriff's denial of a dancer's permit may

ORDAINED that
unless specifically mentioned in

ORDAINED that
Section 8 (B) of Ordinance 85 -11
32 11 shall be amended as follows:

B. Any person may file with the Hearing Examiner a
2
petition to revoke a dancer's license under the same conditions
3
as provided for in Section 5(b). Such petition shall state the
4
grounds for which revocation is sought. Upon receipt of such
5
petition, the Hearing Examiner shall hold a public hearing to
6
determine the merits of such petition. The Hearing Examiner
7
shall give the licensee written notice of such hearing by mailing
8
such notice to the licensee's address as contained in the most
9
recent application. Such notice shall be given no less than five
10
(5) days prior to the hearing.

The Hearing Examiner shall revoke a dancer's license if it
12
finds either of the following:

15 2T 1+. That the licensee has been convicted of a violation
of this ordinance, RCW 69.50 or RCW 9A.88 in
16 connection with the erotic dance studio; or
17 3T That the conditions found in Section 3 have been
violated.

BE IT FURTHER ORDAINED that unless specifically mentioned in
19
this ordinance that all terms and conditions of Section 8 of
20 Ordinance 85 -11 shall remain in full force and effect.
