ORDINANCE N0. 86 -25
AN ORDINANCE AMENDING ORDINANCE NO. 85 -94,
AN ORDINANCE RELATING TO AMENDING THE
FINANCING OF RIVER IMPROVEMENTS AS
ESTABLISHED IN ORDINANCE NO. 84 -59.
WHEREAS, under Ordinance 84 -59 the River Improvement Fund was
established, and
WHEREAS, the procedure and cost split for said projects were also
established in said ordinance, and
WHEREAS, a clarification of that procedure is needed,
NOW, THEREFORE, BE IT ORDAINED that Section 3 of Ordinance 84 -59 shall
be amended as follows:
3. That the County shall participate in the financing, labor or
supply of materials for flood control projects authorized under Chapter 86.12
RCW on sites within Whatcom County subject to fiscal constraints and guidelines
established herein for the prioritization of projects; provided that property
owners shall each pay for thirty percent (30 %) of the cost of the improvements
and benefits to their properties, unless the County Council approves a differer
formula for financial participation in a particular project.' Provided that in
cases of emergencies or the utilization of Federal funds by the U.S. Army Corps
of Engineers, Federal Emergency Management Agency, U.S. Department of
Agriculture, other Federal agencies, or State funds by the Department of Ecoloc
or other State departments, the County Executive may approve a different formul
for rip 'vate property owners' final participation in or on a particular project
to insure that the total participation does not exceed 100% of the cost of the
project or to insure that the rp ivate property owners' cost of improvements
shall not exceed 30% of the normal cost of construction when the cost of the
total rop ject may be increased due to work being performed under emergency con-
ditions or State or Federal guidelines.
