ORDINANCE NO. 86 -16
AN ORDINANCE EXEMPTING A PLANNED UNIT
DEVELOPMENT FROM THE REQUIREMENT OF
OBTAINING A MAJOR DEVELOPMENT PERMIT.
WHEREAS, the official Whatcom County Zoning Ordinance
Section 20.85.400 refers to a twenty-five percent (25 %) reduction
in fees when a Planned Unit Development application is processed
concurrently with a Major Development Permit; and
WHEREAS, both the Planned Unit Development approval process
(Chapter 20.85 of the Zoning Ordinance) and the Major Development
Permit process (Chapter 20.88) provide sufficient project review,
opportunity for public input, and provisions for the imposition of
conditions to protect the natural environment and the public
health, safety and welfare; and
WHEREAS, requiring both permits when application is made
for a Planned Unit Development is redundant and a waste of County
and applicant's time and money; and
WHEREAS, the Planning Department has evaluated the proposed
amendment and proposed an amendment to the Planning Commission
which after giving the required notice held a public hearing on
the amendment and the Planning Commission has adopted the amend-
ment and given the reasons for their adoption to the Council; and
WHEREAS, the Whatcom County Council has reviewed the .findings
and the reasons for the amendment and finds them to be appropriate.
NOW, THEREFORE, BE IT ORDAINED that Whatcom County Code 20.85
shall be amended as follows:

20.85 PLANNED UNIT DEVELOPMENT (PUD)
20.85.400 FEES
.403 Where a planned unit development application
is being processed concurrently with a
conditional use er- yRajer- development permit,
substantial development or shoreline conditional
use permit, or any permit required by the sub-
division ordinance, then the total permit fees
shall be reduced by twenty -five percent (25 %).
This fee reduction shall exclude any fees
required for environmental checklists or
preparation of Environmental Impact Statements.
BE IT FURTHER ORDAINED that unless specifically mentioned
and amended herein all other terms and conditions of Section 20.85
shall remain in full force and effect.
BE IT FURTHER ORDAINED that Whatcom County Code Section 20.88
shall be amended by including a new section as follows:
20.88 MAJOR DEVELOPMENT PERMITS
.285 Where an applicant has applied for a Planned
Unit Development, that project shall be exempt
from the requirement to obtain a Major
Development Permit.
BE IT FURTHER ORDAINED that unless specifically mentioned
and amended herein all other terms and conditions of Whatcom
County Code Section 20.88 shall remain in full force and effect.
