ORDINANCE NO. 87 -37
AN ORDINANCE RELATING TO THE INSTALLATION,
MAINTENANCE AND PROTECTION OF FIBER OPTIC
CABLE SYSTEMS WITHIN COUNTY RIGHT -OF -WAYS,
EASEMENTS AND COUNTY -OWNED PROPERTY.
WHEREAS, the County Council and the Department of Public Works have
expressed concern in the protection of fiber optic cable systems installed
within county right -of -ways, easements and County -owned property; and
WHEREAS, the County's present utility franchises do not address this
concern; and
WHEREAS, the County Council and the Department of Public Works desires
to achieve an agreement of understanding on installation, maintenance and pro-
tection standards between the county fiber optic installers, utilities contrac-
tors, and companies.
NOW, THEREFORE, BE IT ORDAINED that the Whatcom County Council
establishes the following standards for all fiber optic systems installed within
county right -of -ways, easements and County -owned property.
1. DEPTH OF FIBER OPTIC CABLE SYSTEM.
All fiber optic systems shall be installed at a depth of not less
than 36 inches below the road surface or 36 inches below any county ditch line
if installed within the drainage area.
2. ENCASEMENT OF FIBER OPTIC CABLE SYSTEM.
Fiber optic systems shall be protected when placed into the
ground, in one of the following ways:
(1) Conduit system,
(2) Metal armored, shall mean the metal shield within the outside
cable sheath, or
(3) Concrete encasement.
3. ENGINEERING PLANS
Prior to installing any fiber optic system within the county
right -of -ways, easements and County -owned property, an application shall be
filed with the Buildings and Code Administration and approved by the County
Engineer, or his designee, and one set of plans shall be filed with Maintenance
and Operations Division.
4. MARKING OF FIBER OPTIC CABLE SYSTEMS.
All fiber optic cable installers shall mark the installation of
the system with marking tape or locating wire. When marking tape is placed, it
shall be used at 18 -inch depth. Where nonmetalic fiber cable is used, a
locater wire shall be used and must be at same depth as fiber optic cable.
Above - ground signing shall be installed to mark fiber optic cable
systems in rural areas. Above - ground signing system shall be placed every 100
feet or line of sight, whichever is greater.

5. ENCROACHMENT PERMIT.
All contractors, companies, and installers of fiber optic cable
shall obtain an encroachment permit and receive approval thereof for any fiber
optic cable installed within County right -of -ways, easements and county -owned
property.
6. FEES.
Permit fees shall be as and in accordance with Whatcom County
Encroachment Permit Ordinance No. 79 -70.
7. VIOLATIONS.
Any violations of this ordinance shall be cause for revocation of
the franchise of any utility company or corporation and the cause for removal o
fiber optic cable system within county right -of -ways, easements and County -owne
property at the utility's expense.
