AN ORDINANCE IN THE MATTER OF AMENDING ORDINANCE
5 NO. 83 -38, AN ORDINANCE GRANTING A NON- EXCLUSIVE
FRANCHISE TO ROBERT SNYDAR AND .ELVIS HEAD d /b /a/
6 LAKE SAMISH TELEVISION CABLE, FOR A PERIOD OF 25
YEARS TO OPERATE AND MAINTAIN A CABLE COMMUNICA-
7 TION SYSTEM WITHIN THE UNINCORPORATED AREAS OF
WHATCOM COUNTY, PASSED THE 19TH DAY OF MAY 1983,
8 BY TRANSFERRING THE TITLE FROM ROBERT SNYDAR AND
ELVIS HEAD d /b /a/ LAKE SAMISH TELEVISION CABLE
9 TO TCI CABLEVISION OF WASHINGTON.
10 WHEREAS, the Home Rule Charter for Whatcom County, Section 9.30,
11 authorizes the County Council to grant non - exclusive franchises for a fixed term
not to exceed 25 years for the use of any street, road or public place; and
12 WHEREAS, the County Council, on May 19, 1983, did grant such franchise
13 to Robert Snydar and Elvis Head d /b /a/ Lake Samish Television Cable; and
14 WHEREAS, Section 17 of Ordinance No. 83 -38 requires prior approval of
the County Council before the franchise, or any interests therein, shall be
15 transferred, sold or assigned; and
16 WHEREAS, TCI Cablevision of Washington hereby agrees to purchase the
remaining years of the 25 year franchise to operate and maintain co -axial cable
along certain roads in Whatcom County, Washington, and further agrees to abide
17
by all the conditions and requirements within the franchise as granted by the
18 approval of Ordinance No. 83 -38.
19 NOW, THEREFORE, THE WHATCOM COUNTY COUNCIL DOES HEREBY APPROVE the
transfer of title in Ordinance No. 83 -38 from Robert Snydar and Elvis Head
20 d /b /a/ Lake Samish Television Cable to TCI Cablevision of Washington.
