HomeMy WebLinkAboutord1988-092E # 09- 88:CZMT 1 2 DRAFT 2, November 17, 1988 3 (Substitute) 4 INTRODUCED BY: Consent PROPOSED BY: Planning DATE: August 18, 1988 ORDINANCE NO. 88 -92 5 AN ORDINANCE ADOPTING THE TEXT AND MAPS OF THE FOOTHILLS SUBAREA 6 COMPREHENSIVE PLAN AND ADOPTING TITLE 20 ZONING FOR THE FOOTHILLS 7 SUBAREA 8 WHEREAS, the Whatcom County Planning Agency is charged with updating and 9 revising earlier comprehensive plans in order to replace the Interim Zoning 10 Ordinance with the Official Whatcom County Zoning Ordinance, Title 20, and 11 providing recommendations for legislative action to the County Council; and 12 WHEREAS, the Whatcom County Planning Agency has reviewed the Foothills 13 Subarea through development of a Background Document that inventoried and 14 analyzed land use, transportation, community facilities, utilities, recreation, 15 and environmental features of the subarea while determining important economic 16 and land use related issues and developing a citizen participation process which 17 has resulted in development of the Foothills Subarea Comprehensive Plan and 18 zoning; and 19 WHEREAS, the Whatcom County Planning Commission conducted a public hearing 20 on June 8, 1988 for the purpose of receiving public testimony on the proposed 21 comprehensive plan and zoning; and held work sessions on June 28, 1988 and July 22 26, 1988 resulting in findings and recommendations to the Council; those findings 23 are summarized in the attached Planning Agency Report, Exhibit "C ", dated August 24 4, 1988, and incorporated herein by reference; and 25 WHEREAS, the Deputy SEPA Official issued a determination of non - 26 significance on August 3, 1988; and 27 WHEREAS, the Whatcom County Council has reviewed the Planning Agency's 28 Findings, Reasons, and Motion; and 29 WHEREAS, at the Whatcom County Council Committee of the Whole meeting on n 30 September 8, 1988 it was determined that the Council would hold i t,.,s own hearing 31 to consider; higher density residential zoning in the Mosquito Lake Road area; 32 and a request from Stafford Smith, representing Chuck Gable, a prospective 33 purchaser of the Tomyhoi Associates property; and a request from representatives 34 of Glacier Land Company; and 1 F. # 09- 88:CZMT 1 WHEREAS, pursuant to RCW 36.70.590, legal notice was published in the 2 Westside Record Journal on September 28, 1988 for the October 13, 1988 hearing; 3 and 4 WHEREAS, the Council held a public hearing on October 13, 1988 where 5 testimony was received concerning zoning requests for the Raper property in 6 Section 32, T39N, RSE; the Savage property in Section 27, T40N, R6E; the Tomyhoi 7 property in Section 25, T40N, RSE; and the Glacier Land Company property in 8 Sections 7, 8, 17, and 18, T39N, R7E and Sections 1, 12, and 13, T39N, R6E; and 9 WHEREAS, at the Council Committee of the Whole meeting on November 10, 10 1988 the Raper request, the Savage request, the Tomyhoi request, and the Glacier 11 Land Company request were discussed; and 12 WHEREAS, at the Council meeting on November 17, 1988 the Council made a 13 final decision to adopt the Planning Agency's recommended Foothills Subarea 14 Comprehensive Plan and zoning with the attached revisions; 15 NOW THEREFORE BE IT ORDAINED by the Whatcom County Council as follows: 16 Section 1. Comprehensive Plan and Plan Maps 17 The 1970 Whatcom County Plan Text and Maps for the geographic area known as the 18 Foothills Subarea and the 1976 Mount Baker Foothills Supplement to the 1970 19 Whatcom County Comprehensive Plan are hereby amended in their entirety to read 20 as set forth in Exhibit "A" and the map revisions in Exhibit "B" which are 21 attached hereto and incorporated herein by reference. 22 Section 2. Zoning Map 23 The Official Whatcom County Zoning Map for the area referred to as the Foothills 24 Subarea is hereby amended in its entirety as set forth in Exhibit "A" and the 25 map revisions in Exhibit "B" which are attached hereto and incorporated herein 26 by reference. 27 Section 3. Repealer 28 The Interim Zoning Ordinance, Chapter 2.24, Whatcom County Code, text and map, 29 is hereby repealed as far as it affects the Foothills Subarea. 30 Section 4. Validity 31 Adjudication of invalidity of any of the sections, clauses, or provisions of this 32 Ordinance shall not affect or impair the validity of the Ordinance as a whole or 33 any part thereof other than the part so declared to be invalid. 2 FIl 09- 88 :CZMT 1 PASSED this 17th day of November 2 3 4 5 6 ATTEST: 8 Clerk of the Council 9 APPROVED AS TO FORM: , 1988.
