HomeMy WebLinkAboutord1988-0761 2' 3 4 5 6 7 8 9 10 11 12 13 14 15 16 '.7 18 19 20 21 22 23 24 25 26 27 28 29 10 31 32 33 34 35 .6 37 FILE #14 -88:ZT INTRODUCED BY: PROPOSED BY: DATE: ORDINANCE NO. 88-76 AN ORDINANCE AMENDING THE TEXT OF TITLE 20, THE 0 COUNTY ZONING ORDINANCE, TO ALLOW SOLID WASTE INDUSTRIAL ZONES CONSENT Planning Commission 8/4/88 FFICIAL WHATCOM FACILITIES IN WHEREAS, the County is in the process of siting a land disposal facility and finds this process constrained by zoning that does not allow these facilities in industrial areas; and WHEREAS, the County Council requested the Planning Commission to consider the feasibility of allowing such facilities in the Heavy Industrial zone districts; and WHEREAS, it was felt appropriate to examine other industrial zones at the same time; and WHEREAS, pursuant to RCW 36.70.590 and Council directive a legal notice was published in the Westside Record Journal on July 6, 1988, and the Bellingham Herald on July 9, 1988; and WHEREAS, a Determination of Non - significance was issued in August of 1988 by the Deputy SEPA Responsible Official; and WHEREAS, the Planning Commission held a public hearing on the proposal on July 19, 1988; and WHEREAS, after accepting public testimony and due deliberation the Planning Commission accepted the findings and conclusions as presented by the staff and unanimously moved to recommend to the County Council that solid waste facilities be allowed as conditional uses in the Light Impact Industrial zone, General Manufacturing and Heavy Impact Industrial zone; and WHEREAS, the County Council at a public meeting August 18, 1988, reviewed and concurred with the Planning Commission recommendation. NOW THEREFORE BE IT RESOLVED: 1. Title 20, the Official Whatcom County Zoning Ordinance is hereby amended as follows: ADD TO: 20.66.150 (Light Impact Industrial); 20.67.150 (General Manufacturing); and 20.68.150 (Heavy Impact Industrial) CONDITIONAL USES 20.66.155 Solid waste facilities. 20.67.151 Solid waste facilities. 1 1 2 3 4 5 6 7 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 '.6 27 28 29 30 31 FILE #14 -88:ZT 20.68.151 Solid waste facilities. 2. The Council finds that the public health, safety and general welfare are promoted by the above change. 3. The Council further makes the following findings as recommended by the Planning Commission: FINDINGS A. Solid waste facilities are allowed as Conditional Uses in the Rural and Agricultural zones, but are presently prohibited in industrial zones. B. The County is seeking a site for a new disposal facility and needs the maximum flexibility possible to find a site that has minimal environmental and social impacts. C. In future years other facilities may be needed for recycling and transfer of solid waste, activities traditionally more associated with industrial uses. D. Solid waste facilities are regulated by WAC 173 -304 which has siting standards as well as minimum functional standards for different types of facilities. CONCLUSIONS A. Solid waste facilities in industrial zones will create more flexibility in site selection for a new disposal site and for any future needs. B. The state regulations for siting and the normal criteria used for conditional use permits will afford the same protection to adjacent industrial uses that it does for residential and agricultural uses now. 4. Adjudication of invalidity of any of the sections, clauses, or provisions of this Ordinance shall not affect or impair the validity of the Ordinance as a whole or any part thereof other than the part so declared to be invalid.
