HomeMy WebLinkAboutord1988-071FILE #11- 88:IZO INTRODUCED BY: Consent PROPOSED BY: Planning Commission DATE: July 7, 1988 ORDINANCE NO. 88-71 AN ORDINANCE AMENDING THE TEXT OF THE INTERIM ZONING ORDINANCE TO EXEMPT LOTS FORMALLY PLATTED AFTER 1959 FROM LOT CONSOLIDATION REQUIREMENTS WHEREAS, the text of Title 20 was recently amended to not require lot consolidation for lots platted subsequent to 1959 which eliminates a hardship and allows reasonable use of platted lots which do not conform to today's standards; and WHEREAS, similar hardships exist in areas under the jurisdiction of the Interim Zoning Ordinance which may be in place for another two years; and WHEREAS, pursuant to RCW 36.70.590 a legal notice was published in the Westside Record Journal on June 8, 1988, and the Bellingham Herald on June 11, 1988; and WHEREAS, a Determination of Non - significance was issued on June 22, 1988 by the Deputy SEPA Responsible Official; and WHEREAS, the Planning Commission held a public hearing on the proposal on June 21, 1988 and heard all testimony on the issues and after due deliberation accepted the findings, conclusion and recommendation presented by the staff and unanimously moved to recommend that lots platted since 1959 be exempt from lot consolidation requirements; and WHEREAS, the Council at a public meeting on July 21, 1988 reviewed and approved the Planning Commission recommendation; NOW THEREFORE BE IT RESOLVED: 1. The Whatcom County Interim Zoning Code is hereby amended as follows: Modify Section 2.24.640 Non Conforming Uses as follows: .660 Two or more lots of record which exist on the effective date of adoption or amendment of this Ordinance, shall be considered to be used and /or sold as one undivided parcel consistent with the area requirements of the applicable district if all of the following circumstances pertain, except as modified by sub - sections .670 .680 or .685 below: (6) at- least- five- 4-5-)- yearns• -have - passed - si nee- the- 4a-te- -&f- -f4*al-- approval - -of the -pl-at - purauant -to -wh i eh -the -leta -were - ereat-ed .685 2. The Council finds that the public health, safety and general welfare are promoted by the above change. 3.
