HomeMy WebLinkAboutord1988-052I I SUBSTITUTE ORDINANCE FILE #06 -88 INTRODUCED BY: Consent PROPOSED BY: Plannine DATE: May 5. 1988 ORDINANCE NO. 88 -52 AN ORDINANCE AMENDING THE TEXT OF TITLE 20, THE OFFICIAL WHATCOM COUNTY ZONING CODE, TO ALLOW RESEARCH FACILITIES IN THE GENERAL MANUFACTURING ZONE WHEREAS, an application was made to modify the text of Title 20, the Official Whatcom County Zoning Ordinance, to allow university sponsored vocational, educational and scientific testing facilities and related activities, used for research and evaluation of the effects created by the use of manmade products and procedures; and WHEREAS, pursuant to RCW 36.70.590 and Council directive a legal notice was published in the Westside Record Journal on April 6, 1988, and the Bellingham Herald on April 9, 1988; and WHEREAS, a Determination of Non - significance was issued on March 28, 1988 by the Deputy SEPA Responsible Official; and WHEREAS, the Planning Commission held a public hearing on the proposal on April 19, 1988; WHEREAS, after due deliberation the Planning Commission accepted the findings and reasons for action as presented by the staff and unanimously moved to recommend to the County Council that research facilities be allowed outright in the General Manufacturing zone. WHEREAS,, the Council at a public meeting on May 19, 1988 reviewed the Planning Commission's recommendation and determined that there could be a potential problem with research facilities as outright permitted uses; and WHEREAS, the Council held a hearing on June 16, 1988 to consider research facilities as conditional uses in the General Manufacturing zone as opposed to outright permitted uses to insure adequate control; NOW THEREFORE BE IT RESOLVED: 1. Title 20, the Official Whatcom County Zoning Ordinance is hereby amended as follows: ADD: 20.67.150 CONDITIONAL USES (General Manufacturing (GM) District) .151 University sponsored vocational, educational and scientific research facilities and related activities. 2. The Council further makes the following findings: P. FILE #06 -88 FINDINGS A. The Institute of Wildlife Toxicology, Huxley College, which has a national reputation is searching for an off campus facility to conduct its research. B. Research establishments are not specifically allowed in any zone. However there is a need for research facilities in Whatcom County. C. Research is an appropriate use in an industrial zone; a specific parcel is suitable to the Institute in the General Manufacturing Industrial zone; therefore a request for a text change has been made for this zone. D. Research using toxic materials has sufficient hazards that it should be a conditional use. E. The language proposed is unnecessarily specific and could be simplified, 3. Adjudication of invalidity of any of the sections, clauses, or provisions of this Ordinance shall not affect or impair the validity of the Ordinance as a whole.or any part thereof other than the part so declared to be invalid.
