HomeMy WebLinkAboutord1988-028INTRODUCED BY: Consent PROPOSED BY: Plannin,. commission DATE: April 7, 1988 ORDINANCE NO. 88 -28 AN ORDINANCE AMENDING THE TEXT OF TITLE 20, THE OFFICIAL WHATCOM COUNTY ZONING CODE, TO ALLOW HOTELS AND HOTELS IN THE GENERAL COMMERCIAL ZONE AND MODIFY EXISTING REQUIREMENTS REGARDING HOTELS AND MOTELS :IN THE TOURIST COMMERCIAL ZONE WHEREAS, an application was made to modify the text of Title 20 to allow hotels and motels in the General Commercial zone as a permitted use subject to: (1) a minimum lot size of 20,000 square feet; (2) a maximum floor area ratio of 0.60, and (3) located adjacent to a designated Tourist Commercial zone; and WHEREAS, this was an opportunity to review permitting hotels and motels in all commercial zones as outright permitted uses and therefore the hearing was so advertised; and WHEREAS, a determination of non - significance was made on February 8, 1988 by the Deputy SEPA Official; and WHEREAS, pursuant to RCW 36.70.590 and Council directive, legal notices were published on March 2, 1988 in the Westside Record Journal and on March 5, 1988 in the Bellingham Herald; and WHEREAS, the Planning Commission held a public hearing on the proposal on March 15, 1988; and WHEREAS, after due deliberation the Planning Commission accepted the findings and reasons for action as presented by the staff and unanimously moved to recommend to the County Council that hotels and motels be allowed outright in the General Commercial zone with a floor area ratio of .60, and that hotels and motels also be allowed as outright permitted uses in the Tourist Commercial zone instead of conditional uses and that the minimum parcel size of 20,000 square feet be deleted in the Tourist Commercial zone; and WHEREAS, this recommendation was submitted to the Council by the Commisiion in an agency report; NOW THEREFORE BE IT RESOLVED by the Whatcom County Council: 1. Title 20, the Official Whatcom County Zoning Ordinance, is hereby amended as follows: 20.62 GENERAL COMMERCIAL (GC) DISTRICT Add: .064 Hotels and motels. 20.62.300 MINIMUM DENSITY .301 Hotels and motels shall not exceed a floor area ratio of .60. x0.63 TOURIST COMMERCIAL (TC) DISTRICT Add: .063 Hotels and motels. Delete: -151 Hotels- and - motels -251 Hotels -and- motels - shall- Grave- a- mipimdm- +yet- 9arc�l- 5i�e of -- 211,-000 - square feet: 2. The Council accepts the Planning Commission's findings which state that hotels and motels are desirable uses and should be allowed as outright permitted uses in the General Commercial zone. They should also be out- right permitted in the Tourist Commercial zone, with no change recom- mended for the Resort and Neighborhood Commercial zone districts. The requirement for 20,000 square foot minimum lots in the Tourist Commercial zones serves no useful function and should not be made a requirement in the General Commercial zone and should be deleted from the Tourist Commercial zones. The proposed floor area ratio of .60 is reasonable and should be maintained in the Tourist and Resort Commercial zones and required in the General Commercial zone as proposed. The proposed requirement; to allow hotels and motels only in those commercial zones contiguous to Tourist Commercial is unnecessary and should be deleted. 3. The Council further finds the public health, safety and general welfare are promoted by redesignation of the subject property to limited commercial use. Adjudication of invalidity of any of the sections, clauses, or provisions of this Ordinance shall not affect or impair the validity of the Ordinance as a whole or any part thereof other than the part so declared to be invalid.
