DATE INTRODUCED: MARCH 3, 1988 ORDINANCE NO. 88-22 AN ORDINANCE IN THE MATTER OF RE- ESTABLISHING THE WHATCOM COUNTY DEPARTMENT OF PUBLIC WORKS, IN ACCORDANCE WITH HOME RULE CHARTER FOR WHATCOM COUNTY, PROVIDING FOR THE REPEAL OF WHATCOM COUNTY CODE CHAPTER 2.76, RESOLUTION DATED SEPTEMBER 20, 1978 AND ORDINANCE NO. 83 -73, DESIGNATING THE DIVISIONS, AND INCORPO- RATING WITHIN THE WHATCOM COUNTY CODE A NEW CHAPTER 2.77. WHEREAS, the Whatcom County Commissioners created the Department of Public Works on September 20, 1978 and incorporated it into the Whatcom County Code as Chapter 2.76; and WHEREAS, the Home Rule Charter for Whatcom County, effective May 1, 1979, Section 2.20, provides that the County Council shall exercise its legisla- tive powers by adoption and enactment of ordinances or resolutions and shall have the power to establish by ordinance non - elective administrative offices and executive departments and to establish their powers and responsibilities; and WHEREAS, the Whatcom County Council deems it is necessary and in the best interest of the citizens of Whatcom County to re- establish the Department of Public Works, designating the divisions and providing for the repeal of Whatcom County Code Chapter 2.76 and establishing Whatcom County Code Chapter 2.77 codified, in accordance with Home Rule Charter for Whatcom County Section 2.60. NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that there is established a Whatcom County Department of Public Works, hereafter referred to as the "Department," an executive department of the County, and this ordi- nance hereby repeals Whatcom County Code Chapter 2.76 and establishes Whatcom County Code Chapter 2.77 codified. BE IT FURTHER ORDAINED that unless,specifically mentioned and amended in this ordinance, all other ordinances, administrative rules and resolutions in force at the time of the adoption of this ordinance, which are not inconsistent with this ordinance, shall remain in force until amended or repealed. CHAPTER 2.77 PUBLIC WORKS DEPARTMENT Section 2.77.010 Organization The Department shall include, but is not limited to, the following divisions: A. Division of Buildings and Code Administration B. Division of Engineering C. Division of Maintenance and Operations D. Equipment Rental Division E. Ferry Division F. Division of Building Maintenance ORDINANCE - 1. Date drafted: 2/10/88 1 2 3 4 5 6 7 8 9 10 11 12 13. 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Section 2.77.020 Funds The Director shall administer the funds for the Department as established by the County Council in accordance with state and local laws, and policies and procedures as established by the County Executive. Section 2.77.030 Appointment of the Director The County Executive shall appoint the chief executive officer, hereinafter referred to as the Director of the Department of Public Works, subject to confirmation by a majority of the County Council. The Director's appointment shall be for an indefinite term and will serve at the will of the County Executive. Section 2.77.040 Staff It shall be the responsibility of the Director to hire the depart- ment staff in accordance with personnel policies and procedures of the County and any other applicable laws and regulations. Section 2.77.050 Duties and Responsibilities of the Director Duties and responsibilities of the Director shall be in accordant( with this chapter or other ordinances, administrative rules and resolu- tions in force at the time of the adoption of this ordinance or by future ordinances apprroved by the County Council and the County Executive. Section 2.77.060 Severabilit If any section, subsection, sentence, clause, phrase, or portion of this chapter is, for any reason, held to be invalid or unconstitu- tional by the decision of a court of competent jurisdiction, such deci. sion shall not affect the validity of the remaining portions of this chapter.
