DATE INTRODUCED: January 7, 1988 ORDINANCE NO. 88 -6 ORDINANCE IN THE MATTER OF AMENDING WHATCOM COUNTY CODE CHAPTER 2.64 SECTION 2.64.040 MILEAGE RATE. PROVIDING THE RATE AT WHICH OFFICERS AND EMPLOYEES OF WHATCOM COUNTY ARE ENTITLED TO BE REIMBURSED FOR PREAUTHORIZED USE OF PERSONAL AUTOMOBILES OR OTHER TRANSPORTATION EQUIPMENT IN CONNECTION WITH OR IN THE COURSE OF THEIR OFFICIALLY ASSIGNED DUTIES OR OTHER APPROVED TRAVEL IS FIXED AT NINETEEN CENTS PER MILE OR A FLAT MONTHLY RATE IF THE COST IS LESS THAN PROVIDING A PUBLIC VEHICLE IN ACCORDANCE WITH RCW 42.24.090. WHEREAS, Whatcom County Code Section 2.64.040 establishes the rate at which officers and employees of Whatcom County are entitled to be reimbursed foi their pre- authorized use of personal automobiles or other transportation equip- ment in connection with or in the course of their official assigned duties or other approved travel at 19 cents per mile; and WHEREAS, RCW 42.24.090 provides that unless otherwise authorized by law, the County Council may prescribe by ordinance or resolution the amount to be paid officers or employees thereof as reimbursement for the use of their per• sonal automobiles or other transportation equipment in connection with official assigned duties and other travel for approved public purposes. The rate for such reimbursement may be computed on a mileage, hourly, per diem, monthly, or other basis as the County Executive shall determine to be proper in each instance if the County Executive determines that the payment will be less costl; to the County than providing County -owned automobiles or other transportation equipment for official use; and . WHEREAS, it has been determined by the County Council that in certain cases payment for the use of personal automobiles or other transportation equip• ment is less costly to the County than providing County -owned automobiles or other transportation equipment. ORDINANCE - 1. Date drafted: 12/15/87 1 1 2 3 4 5 6 7 8 9 10 11 12 13. 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that Whatcom County Code Section 2.64.040 is hereby amended to read as follows: The rate at which officers and employees of Whatcom County are entitled to be reimbursed for preauthorized use of personal automobiles or other transportatio equipment in connection with or in the course of their officially assigned duties or other approved travel is fixed at nines, pn twenty -one cents per mile or a flat monthly rate as set by the County Executive if the cost is less than providing a public vehicle in accordance with RCW 42.24.090. To the extent they are available, County -owned automobiles and other transportation equipment shall be utilized for County travel purposes by officers and employees before privately -owned vehicles are used on a reimbursement basis. The County Executive shall be authorized to grant exemption from this provision when the cost of a County -owned vehicle would exceed the cost of the use of a privately - owned automobile or other transportation equipment. Officers or employees shal receive prior written approval of the County Executive and such approval shall indicate the rate and method for such reimbursement for privately -owned auto- mobiles or other transportation equipment. BE IT FURTHER ORDAINED that unless specifically mentioned within this ordinance, all other terms and conditions of Whatcom County Code Chapter 2.64 shall remain in full force and effect.
