HomeMy WebLinkAboutord1989-073V C INTRODUCED BY: Hansey PROPOSED BY: Executive DATE INTRODUCED: 8 -31 -89 ORDINANCE NO. 89 -73 All EMERGENCY ORDINANCE ADOPTING THE OFFICIAL WHATCOM COUNTY ZONING ORDINANCE, TEXT AND MAP, TITLE 20 OF THE WHATCOM COUNTY CODE, FOR THE LAKE WHATCOM SUBAREA OF THE VIHATCOM COUNTY COMPREHENSIVE PLAN; AND ADOPTING THE COMPREHENSIVE PLAN FOR THE LAKE WHATCON SUBAREA WHEREAS, Whatcom County Ordinance 84 -04 which amended Ordinance 82 -58 is found to contain a provision for the expiration of the Lake Whatcom Subarea Comprehensive Plan and official Whatcom County Zoning ordinance text (Title 20) and map, which would allow the zoning to revert back to the Interim zoning for the Lake Whatcom Subarea; and, WHEREAS, Lake Whatcom is the potable drinking water supply for the City of Bellingham and other areas within the County, and further development within the Lake Whatcom Watershed must be limited to a quantity and density which is consistent with the overall maintenance of a safe and adequate water supply, and WHEREAS, it has been determined by the County Council that an emergency exists that requires immediate action by the Council for the health, safety and welfare of the citizens of Whatcom County, and WHEREAS, RCW Chapter 36.70 empowers the County to enact a zoning ordinance and provide for the administration and enforcement, NOW, THEREFORE, BE IT ORDAINED by the County Council that an emergency exists that requires immediate action for the health, safety and welfare of the citizens of Whatcom County, and _ BE IT FURTHER ORDAINED that the County Council hereby adopts the Lake Whatcom Subarea Comprehensive Plan and official Whatcom County Zoning Ordinance, text and map for those areas of Lake Whatcom Subarea as shown in Exhibit A and contained in the November 1988 edition of Title 20, including the subsequent amendments thereto and that portion of the zoning ordinance which proposed urban level uses and densities within the watershed designated on the zoning map as Urban Residential Low, 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 Urban Residential Medium, Resort Commercial, Rural Residential Two (two dwelling units per acre) , and Neighborhood Commercial, and repealing all other portions of the ordinance that are in conflict with this ordinance, and BE IT FURTHER ORDAINED that this ordinance is adopted pursuant to 2.40 of the Whatcom County Charter and therefore shall expire on the 61st day following the date on which this ordinance becomes law. BE IT FIWAULY ORDAINED that it shall be the policy of the What - com County Council to have the final ordinance before it in sufficient time for it to be effective no later than October 31,-1989.
