WHEREAS, Ordinance No. 86 -88, Miscellaneous Provision A, limits the number of crew members on the Whatcom Chief to two, even during periods of heavy use; and WHEREAS, such limitation precludes efficient transport of passengers and vehicles between the mainland and Lummi Island, creating a hardship situation for citizens unable to secure passage; and WHEREAS, it has been determined by the County Council that an emergency exists that requires immediate amendment of Ordinance No. 86 -88 for the health, safety and welfare of the citizens of Whatcom County. NOW, THEREFORE, BE IT ORDAINED that the Whatcom County Council hereby declares an emergency exists for the health, safety and welfare of the citizens of Whatcom County that requires an immediate amendment to Ordinance No. 86 -88 by eliminating Miscellaneous Provision A, which requires that the maximum passenger capacity of the Whatcom Chief shall be no greater than that allowed by Coast Guard regulations for a two - person crew.
