EMERGENCY ORDINANCE NO. 89 -25
AMENDING THE WHATCOM COUNTY CODE, ADDING TITLE 24,
THE WHATCOM COUNTY HEALTH CODE
WHEREAS, the Bellingham - Whatcom County Health District dissolved at
midnight, March 31, 1989, and the Whatcom County Health Department was
simultaneously created; and
WHEREAS, Ordinance 89 -24 establishes the Whatcom County Health Code,
Title 24, and will not take effect until April 10, 1989; and
WHEREAS, an emergency exists in that the newly- formed Health Department
will not have rules and regulations in place to safeguard public health and
welfare until Ordinance 89 -24 takes effect;
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that an
emergency exists and this ordinance shall take effect upon Council's adoption
and approval by the Executive, and shall remain in force until Ordinance 89 -24
takes effect; and
BE IT FURTHER ORDAINED that the Council finds this ordinance is
necessary for the immediate preservation of the public peace, health, safety
and /or support of the government; and
BE IT FURTHER ORDAINED by the Whatcom County Council that the following
is hereby adopted as the Whatcom County Health Code, to be codified as Whatcom
County Code Title 24 in its entirety, including the schedule of fees and
charges listed in "Exhibit A ":

WHATCOM COUNTY HEALTH CODE
24.01
PURPOSE.LIMITATION ON LIABILITY AND DEPARTMENT ESTABLISHMENT.
24.01.010 - Purpose.
This Title is enacted as an exercise of the police power for the benefit of
the people at large. It is not intended to create a special relationship or
private right with any individual or individuals, nor to identify any
particular class of persons. The purpose of this Title is to provide minimum
standards to safeguard public health and welfare by regulating and controlling
the activities considered herein and any related work. It is not the intent
of this Title to impose liability upon the County for failure to perform any
discretionary act. Rather, it is the intent of this Title to place the
